Tier 2 general extension

Post by yash_d » Sat Nov 07, 2020 10:23 am

Hi does anyone know what happens in the following situation
1. You apply for extension of your current visa well before the expiry but the result comes after the expiry of the current brp and unfortunately its rejected. What options do you have apart from admin appeal. Does cooling off apply? (Am talking abt tier 2 general visa extension)
2. You apply for extension before expiry of your current leave and it gets approved but the start date on new brp is later than expiry date on old brp. (For eg expiry date on current brp 10th nov 2020, and start date on new brp 15th non 2020) does this affect your right to work or ilr in anyway.
Both the situations are hypothetical and havent happened to me or anyone i know but waiting for my visa and thinking of all diff scenarios 🙈🙈🙈

1. PBS migrant dont have appeal rights. You only have admin review option and that is only if you believe ukvi made a mistake, which is rare for tier 2 extensions. If a new tier 2 application with a new CoS is submitted after refusal and approved, the overstay should be ignored. You can't work though till a new visa is granted.

2. No issue.

Stop overthinking and asking about issues that potentially will not happen.

Thanks CR001 for you reply.
In scenario 1 can you also confirm if the overstay is ignored post successful new tier 2 application, will it reset the ILR clock?
