Redundancy on Tier 2 General Visa

Hello Everone,
I am currently on Tier 2 General visa but I am being redundant and my last day is 30th Oct 2020. I have completed 4 years on tier 2 general visa and one year remaining for my ILR which is due in Nov 2021. my husband and daughter are on my dependant Visa.

1. How much time we will get after 30th oct to stay in UK.
2. In current covid situation finding job is difficult so does home office consider these circumstances in order to allow us more time period?
3. How much time does it take to receive the curtailment letter from home office?

A curtailment letter can take a while to get sent out, often a few months. Your 60 days curtailment starts from the date of the letter and not your last employment date.

1. Do you know in current situation whether UK governement is giving more time for Tier 2 General visa holder people to find job more than two months?

Can home office give extra time if the worker has a dependant under the age of 18?

No they won't check your family situation and take it in account. They will just issue the curtailment at one point. It may take months. That should give you time to dig around for another job & sponsor.

There is no employment gap rule. It was removed a couple of years ago but used to be 60 days.

Whether home office has announce or will allow any immigration concessions for sponsored workers who have lost or are at risk of losing their job due to the COVID-19 situation.

Unless they changed it due to Covid, normally it's a letter. When you get the letter, the 60 days start. Make sure your have an up to date address with the Home Office.

They are not giving concessions to people who lost jobs due to Covid. It would be really hard to implement as they would need to investigate each job loss to see if it's Covid related or not.

Hello Team,

Can you please comment on below questions?

1. I am eligible for ILR in Oct 2021. In case if I switch employer in this period so do I need to apply a Tier 2 general visa for 3 years? On the website, I can see Up to 3 years and More than 3 years but I will require just 1-year visa to apply for ILR.

2. I have already paid IHS health surcharge till Oct 2021 so again if switch my employment do I need to pay health surcharge again?

3. I have two dependents as I am the main applicant. So if I get new sponsorer then my dependant also need to apply for a new visa? Their current visa is valid up to Oct 2021 as mine.

In the current pandemic scenario, an employee can start working once COS is assigned by the employer?
Or he needs to wait till visa application is processed?

If you’ve applied for a Tier 2 or 5 visa and are waiting for a decision on your application
You can start work before your visa application has been decided if:

you’ve been assigned a Certificate of Sponsorship (CoS)
you submitted your application before your current visa expired and you show your sponsor evidence of this
the job you start is the same as the one listed on your CoS
If your application is eventually rejected as invalid or refused your sponsor will stop sponsoring you and you must stop working for them.

Tier 2 Dependent Visa question

As mentioned above I am Tier 2 General Visa with validity till Oct 2021 but my role got redundant.

However, I am changing my employer who will be sponsoring my new Tier 2 VISA which will be valid till Dec 2022. My question is do I need to reapply for my dependents’ visas now as well? Or they can continue with their existing visa till expiry oct 2021 and then reply.
Please note that I have checked the UKVI guidelines but I could not locate any clear guidelines around this. So I was hoping if anyone is aware about this based on their experiences.

Go to page 11 and read point 61
If the Main Applicant changes employer or educational institution and is therefore issued with a
new certificate of sponsorship/confirmation of acceptance for studies and is applying for leave to
remain to work or study under their new sponsor, PBS dependants do not have to apply with them
for leave to remain. Instead PBS dependants can remain in the UK until the end of the validity
period of their existing PBS dependant leave. They can later apply for leave to remain to bring
their leave in line with the leave of the PBS migrant. Dependants of Appendix W Workers should
apply to switch at the same time as the Main Applicant.
