ILR 4-5 Years ..plzzzzz help ASAP

Post by rashidshah » Sun Sep 14, 2008 9:52 am

Hi All
i have a legal stay of 4years(work permit)+1year(student). I intended to apply for ILR now. But rules have been unfairly changed and now have to wait for 5 years even when i was given my work permit , it used to be 4 years..
But while searching on the internet , i realised there was a court case against that .Can anyone guide/help me on
1)what the verdict was?
2)should i apply for it after 4 years NOW
3)Copy of that verdict please
ThanX

Does nt matter if it was 4 yrs when you got it
Does nt matter if there was any Court Appeals

What you are referring to has no bearing on your case. Its 5 yrs of Work Permit to qualify for ILR.

ThanX for taking intrest dubble truble
HO was taken into court for that , i have read the judgement . WP ppl lost the case as none of them actually had even 4 years of WP.
After recent HSMPians judgement by court , is it worth appealing again ?
Because it is unfair . they have changed the goal post after match kicked off !!!

yes, there was a court case, but they lost. this was late last year. i can no longer find their website but the organisation was called VBSI.

because they lost, you will have to wait 5 years to get permanent residency.

Like everyone else, who was effected by this change you to will have to sit out your five years and even be force to extend your visa at your cost.
Sorry that's the new law all be it unfair.

Yep that's right they(HSMP visa holders) won the case, but typical of HO they delay the implementation for as long as possible in a hope that people will give up and go away.
