Apply BC after refusal in 2017

Post by middletier 1 » Thu Nov 05, 2020 5:27 am

Hi,

I have refused my British Citizenship application in Sep'2017 and now 3 years have completed thus thinking to apply for BC now.

The reason for refusal - I was involved in a domestic case in May'17 after I was applied for BC in Mar'17 and I have immediately informed the home office as change in circumstances in May'17 itself, however in the rejection letter they mentioned that as I didnt inform them thus I can't apply in ten years. refusal letter mentioned as;

"it is open to you to reapply for citizenship at any time but your failure to disclose a conviction to us will be taken into consideration on any fresh application made within ten years of this date of this letter and is likely to lead to the application being refused".

Actually I have informed them with all the details of my case ref and court dates everything in the email, but they haven't considered thus rejection letter mentioned as above.

I have discussed with couple of solicitors and they are advising to apply now as I have the email proof, however I want to get the suggestions/advises from this broad which I feel more useful as I am using this board since my Tier 1 application.

Thus please advise me whether is it ok to apply now or wait for another 7 years before I apply, I really appreciate your help.

Thanks

A review seems more appropriate than a fresh application.

Is there any time limit for the review as the application was refused in 2017?

Hi Vinny/Cullinan,

many thanks for your suggestions and replies.

I think I can apply for review now as it seems no timelimit for review but as I was convicted in 2017 so my previous application decision remains same which was refused however they might reduce the timelimit for re apply from 10 years to 3 years. So in that case I am thinking to apply as fresh now with the email proof as 3 years already completed. If they consider my email proof and rest all ok then I might get my BC fresh application could be accepted, please advise.

please note that if I ask for review now for 2017 refused BC application then decision still remains same as they can't be approve my 2017 application but for a fresh application I am thinking I might have chance for approval. Appreciate your responses and please advise

Regards

If the review is successful, then they may grant citizenship without the need for a fresh application. Else, fresh applications may fail until the ten years have passed.

Hi Vinny,

Thanks for your prompt reply and I am thinking whether HO might ask why I didn't apply for review in 2017?
