Hi all, kindly assist with some suggestions/advise. thank you.


what are the likely consequences of applying for a work permit after holding a full-time job for over three years. the first couple of months were with the same employer, via an Agency but on a STUDENT visa.

the student visa was later swited to a SPOUSAL DEPENDANT's visa.

can this same employer cause any problem if it is discovered that a full time employee they got through an agency 3 yrs ago was actually on a student visa then?

can the home office still refer to that issue even though the visa is no longer a student, but a student- dependant, and a student-dependant can legally hold a full time job?

can a refence to working more than 20 hrs while on a student visa over 3 yrs ago be referred to now, if an application is now made for a work permit ie changing from a spousal dependancy visa to a work permit?

never took any benefits, public funds.

I don't suppose the employer is likely to make an issue of it, they probably wouldn't want to draw attention to themselves.

If UKBA look into it to the extent of realising that part of your employment history includes working full time while on student conditions, they can hit you with Para 322 (3) of the Rules:

"failure to comply with any conditions attached to the grant of leave to enter or remain;"

If your offence was for a relatively brief period, and they subsequently gave you LTR as a spouse dependant, you've probably got away with it.
