10 Year Long term route Query

Dear Members,

Can you please comment on below scenairo.

My first UK short term visa was valid from 08-08-2014 to 04-08-2015 and next ICT long term was from 10-10-2015 until sep 2020 and Now I have switched to student visa until Mar 2021. As part of current Extended job search visa, I will most likely get an extended visa until 2023.

I wanted to get feedback if the gap between 08-2015 until 10-2015 (almost 2 months) will be considered as a break period OR will this be scenario be treated as a case of continuous residence.

Kindly advise.

It would be treated as continuous by virtue of section 3C provided you had applied in timely.

Thanks. Can you please elaborate on the point "applied timely"?

Few more details - I flew out of the UK end of july 1015 back to my home country...and started my next visa processing afresh in sep 2015 and flew back to UK in 3rd week Oct of 2015.

Please advise.

Since you left before your leave expired and returned within 6 months, your continuous residence was maintained. So you will be able to apply through the 10 year long residence route (Set LR) in 2024 and 28 days minus the 10th anniversary date of first entry in 2014. That is of course, assuming that the rules remain the same between now and when you will be eligible to apply in 4 year's time (2024).
