SOC CODE Letter from Employer

SOC CODE Letter from Employer

Hi! Has anyone here had a successful application (or have an ongoing application) for ILR Tier 2 without a SOC CODE letter from their employer (because they won't provide it for some reason)? Did you have to do an alternative letter or cover letter for this? As my employer still would not provide me this document and I have my Biometrics appointment next week. Thanks!

You don't need a letter. You simply need the cos details to put in the application form.

Thanks CR001. I just asked because it is one of the supporting documents required in my application which says:

1. A document from the sponsor who issued the certificate of sponsorship that led to your last permission to stay as a Tier 2 migrant confirming that you are:
a. still required for the employment in question for the foreseeable future, and in the case of Tier 2 (General), Tier 2 (Sports Person) and Tier 2 (Intra Company Transfer) migrants this document should also contain:
b. the nearest applicable SOC code which best describes your employment
c. your current rate of pay (this should be given in the same format as given in the codes of practice, for example hourly rate or yearly salary), and
d. confirmation that this is at or above the appropriate rate for the job as stated in the codes of practice for Tier 2 sponsors.

My employer is adamant they will not provide this letter or document for me, as they have already provided me a Certificate of employment and those details are reflected in my COS anyway. I am just not sure why the HO is requiring a separate document for this. So I don't need to provide a cover letter in my application to explain this? Thanks

The letter you quite is mandatory for ilr, has to list your employment details. It is not simply an SOC letter as you have stated in your heading.

It has to be a letter form your employer detailing your job details including salary. You also need an absence letter from the employer.

You risk a refusal if you don't submit these mandatory letters.

By employer you mean HR or your department folks? You can try to get that letter from a senior member in your department in case HR is not helping you out.

Thanks for replying. I have requested for the document from my HR department as my manager would not sign it as she does not have any idea about my sponsorship details, SOC code etc so she said it should be the HR's job to provide the letter for me

Hmm... send the ukvi rules, etc. to your HR and that is a mandatory document for your application.

1. Immigration rules – paragraph 245HF.

Depending on the sector you work, search for other organisation websites how they provide such letters to their employees and send such examples to your HR to say it's done by other organisations as well.

Convince them and also mention how much your application going to cost and the risk of rejection in case they don't support your application. Ask your manager to tell HR to support your application. Find out who in HR deals or specialises in immigration related applications and try to talk to them.

I have already done that and explained both to my manager and our HR how important this document is. I am personally going to our HR office tomorrow (as they have not been very good in replying to my emails + there was a lack of support from them) and will literally cry in front of them until they give me the letter :lol: haha

I know, I had to do similar thing with my HR and it took a couple of weeks for them to provide the letter in the required format after numerous emails.

Worst case if they don't provide the letter then say you'll attach the email correspondence so ukvi can contact HR department of they have any further questions. Don't use this card until you try again and again.

Try to keep the email chain professional and make your position clear so you can use it in worst case scenario.

Are you the only person on Tier 2 in your company?

No, the strange thing is, there's hundreds of us on Tier 2 working for them and they said they have never supplied such a document before. I will see tomorrow as I am gonna go to their office and will not leave until they give me the letter. This has taken me nearly 6 weeks asking for this document from them. But thanks for the advice, I still really do hope I get it sorted by tomorrow and not have to use that card :lol:

Better to take a template in soft copy which they may use so it can speed up your process and you may save some tears 😜

Yeah, as CULLINAN mentioned fill the template letter with all relevant info and tell them that there is nothing extra to what they already know. Make it as easy as possible for them.

All you need is that letter on a letterhead.
