AN is based on last 10 years checks. You should apply when you have legal status in UK for last 10 years.

You will loose the fees. But you can apply when you have 10 years legal stay again if refused.

You will be refused no matter what you have if you don’t qualify for the 10 years legal stay

10 year from when

Post by Fezan » Fri Dec 18, 2020 8:56 pm

Hello,
I was about to pay and submit for british citizenship, but thank you to **Culllinan** he asked me to read 10 year good requirement..

In 2010, I did not have any paper work, got married to french national in 2012.. got my resident card for five year in March 2015, then got my indefinate in august 2019. Settle stattus. I Indefinate

My question will I be ok to apply for citizenship in April 2025, obviously I have to meet the requirements of that time...

Plz.. clarify my doubt...

Many many thanks

Also, is it any way now, i get citizenship, if I go court, or challenge home office decision.. Money is not too serious issue with me

Hello
If money isn't the big issue then you can try .They look for people for money isn't the issue as they need money & that's the reason they have completed the rules .If you explain the reasons for overstaying or staying illegally ,a nice caseworker which is rare can have a compassion & apply discretion .They make weird decisions sometimes by breaking their own guidance as we have seen some decisions where people have been illegal in last 10 years at some point but got citizenship granted out of blue .Granting citizenship to someone with ILR isn't a very big decision .They are just weird ,arrogant & exploitative .There isn't any justice in the UK immigration system anyway .

You can go to high court for Judicial Review if home office refuses your application for citizenship. Even high court's who have power but rarely apply it .They simply don't use their power & let the home office play it's game.

I doubt that going to court will do much good. The courts recognise that the Home Office has significant discretion in granting naturalisation and that there is no right to naturalisation if the requirements set out by the Home Office are not met.

If you married a French national in 2012, did you marry in the UK or abroad? Was that a civil marriage or a religious marriage?

True for the individual concerned. For an individual living in the UK, there is very little difference between ILR and British citizenship.

But it has more ramifications for the government and the UK than it has for the individual themselves. Which is why the government makes as careful an assessment of the individual as it can, with its strict requirements.
