from tier 2 dependent to ILR dependent

Post by SamLon » Mon Dec 07, 2020 1:48 am

Hi all, I am sorry if this is a silly question or has already been asked.

I am on tier 2 visa and will be eligible for ILR in March next year. My wife joined 6 months after I started working on tier 2 visa and that means she is eligible 6 months after me, that is, September next year.

My question is

a) Should I extend my tier 2 visa and then apply with my wife for ILR in September
b) Or should I get my ILR in March and my wife gets her in September.

To me option B is attractive, but I am confused about the status of my wife if I move to ILR in March. Particularly

a. If I get ILR and she moves to ILR dependent for next 6 months, will her 5 year cycle reset because of change in the type of dependent visa. What I mean is that she will have to do full 5 years from the day she shifts to ILR dependent or not?

Any advice or help on the topic is really appreciated. Thanks.

Option b.

If she changes her visa to ilr dependent on frl m, her ilr clock resets to zero and new 5 year route to ilr, 2 X 2.5 year visas.

If you get ilr based on tier 2, her PBS dependent visa if you extend both of yours, remains valid.

What date was her initial visa issued?

That's great. Thanks a lot. Both our visas (tier 2 and tier 2 dependent) expires on same date- 1st March.

So am I correct in assuming that

a) I need to extend my tier 2 visa (and by that extension my wife's tier 2 dependent visa) before March. How early I can do this?
b) get my ILR in March as I complete 5 year cycle then.
c) my wife does nothing and stays on tier 2 dependent visa till September when she completes her 5 year cycle and applies for ILR then
