Visa for Dependents after ILR

Post by VKandi » Thu Nov 26, 2020 3:04 pm

Dear All, I need help to understand following.

I am on Tier 2 ICT Long term visa at present and my dependents visas are sponsored by the company I work for. I am going to apply for ILR in few days and I would like to know what will happen to my Original ICT and dependent Visas once I get ILR. Do they get automatically cancelled? Do I need to plan ahead of receiving my ILR to apply for Dependent Visas myself? Kindly help. Thanks.

Assuming you are applying for ilr based on 10 years long residence (your post state your route), your dependents have to switch to FLR m spouse visa and meet the English and financial requirements. Their 5 year ilr clock will reset to zero.

UK born child can be registered as British once either parent is granted ilr.

Thanks for your response.
Yes, it is 10 Years long residency route. Can the switch happen after i get ILR or should i initiate it along with my ILR application?
Does this mean my dependents need to wait for another 5 Years to be eligible for ILR?
Also, kindly let me know what are financial requirements.

Yes, provided they still have a valid visa.
or should i initiate it along with my ILR application?
Only if their visas have a short validity left.
Does this mean my dependents need to wait for another 5 Years to be eligible for ILR?
Yes. FLR(M) will be 2 x 2.5 year visas before they can apply for ILR (spouse and any non UK born children).
Also, kindly let me know what are financial requirements.

Sorry my mistake it was not even 4 years in UK. My partner came to UK in Nov 2013 and lived in UK until Feb 2016.She had to travel due to pregnancy and delivered baby in India. She came back to UK on Feb 2017 and continuing here. is that gap counted if we apply ILR application for her along with me? Is there any other way other than waiting for 5 more years? Thanks in advance.

The gap breaks her continuity of residence if you are referring to her applying for ILR based on 10 years long residence.

No,

Hi,

One final clarification needed. My dependents Visa is Valid until Sept 2021. If I receive ILR in March 2021, what happens to her dependent Visa, which is sponsored by the company I work for?
Does it get automatically cancelled? Or
can I wait until their old Visa expiry date (Sept 2021) and initiate FLR(M) somewhere in Aug-Sept 2021?

Despite her existing visa won't be cancelled/curtailed instantly unless won't travel but she should immediately switch into flrm visa soon after of you secure your ILR.
