Dependent visa for children - Parent with ILR

Hi All,

Greetings.

Seeking your help with the below query.

1. I have been on Tier 2 ICT Long Term visa since Sep 2010. So applied for ILR in Long Residence route. Pending decision
2. My wife is on Tier 2 General since Aug 2015. She has got her ILR recently
3. Our Son was born in India. He has been here in the UK as my dependent (PBS dependent) since Dec 2015, which is valid until April 2021.

Now question is, what kind of Visa I should apply for my Son?
1. Can I apply ILR for him as my wife has got ILR? (but he has been my dependent since beginning)
2. Can I apply for ILR dependent?
3. Can I extend the current dependent visa (PBS dependent)?

Appreciate your help and thank you in advance.

Please let me know if any further details are required.

You cannot extend his PBS dependent visa.

Apply for ilr on form set F once both parents have ilr and before his visa expires

Thanks CR001. Appreciate your quick response.

I have recently applied for my ILR so not sure if I will get it before his Visa expires. That's why I am thinking of the option of ILR dependent for my wife. Would that be possible? If so, which set of the application I should be using?

It is unlikely your ilr will be delayed till April.

Yeah I am hoping so. Just as a backup plan, can he switch to an ILR dependent for my Wife?

Why do you want to waste money with an unnecessary visa and IHS application??

Just so you are aware, a child ilr dependent visa for 2.5 years costs over £2500, visa fee and IHS.

Best to wait for a couple of months for your ilr first.

If he is born abroad, he needs ilr first before citizenship. So switching him now to a 2.5 year visa, unlikely to be granted as you don't have ilr yet, will only cost you more money plus ilr fees.

Ilr is £2389

There is no cheap shortcut route for a child born abroad. Simply apply for ilr before his visa expires once you have ilr.

Hi CR001,

Greetings.

Got my ILR today. Thanks for the timeline thread you created. It helped a lot.

I am about to submit ILR application for my Son. Just wanted to reassure that I should be submitting Set (F) application in the below scenario? Could you confirm please?

1. I have got my ILR on LR route (set (LR))
2. My wife has got ILR on 5 year route (Tier 2 General - set(O))
3. Our Son was born in India. He has been here in the UK as my dependent (PBS dependent) since Dec 2015
