How to apply for Child Over 18 Outside UK

Hi All
My Friend to apply for her family to bring to UK as Spouse from Pakistan. There are queries need to get your suggestions.

1) Does a child who has already British citizen need to count for Income requirement or not as per below from website don't need but still your experts opinion will confirm it further.

2) One of the Child is Over 18. How to apply for that as she is not under 18 and can't be added into application with mother.

If need to apply as //Apply as an adult coming to be cared for by a relative . There are 3 Options, so he need to select Option1 or Option 3. In Option 3 does both Parents need to be settled or only one parent settled is enough, in this case only Father has settled and British National and mother is applying to join him as spouse now.

APPENDIX 1 (VAF4A November 2018)

On what basis are you going to the UK? Put a cross (x) in the relevant box
    As the adult dependant relative of a person who is present and settled in the UK
      As the adult dependant relative of a person with limited leave to enter or remain in the UK as a refugee or as the beneficiary of
      humanitarian protection
        As the child of settled parents or with one parent who has limited leave as a partner or parent granted under the Rules in forcebefore 9 July2012.

        1. No.

        2. Child over 18 will have to find their own visa route to the UK they qualify for. Child settlement visas apply to children under 18. Adult dependent relative is not relevant to the over 18 child either

        You must be outside the UK to apply and need long-term care from a parent, grandchild, brother, sister, son or daughter who is living permanently in the UK.

        One of the following must also apply to the relative:

        they’re a British citizen
        they’ve settled in the UK - for example, they have indefinite leave to remain, settled status or proof of permanent residence
        they have refugee status or humanitarian protection in the UK
        If your family member has settled status you may also be eligible to apply to the EU Settlement Scheme or for a family permit.

        You must prove all of the following:

        you need long-term care to do everyday personal and household tasks because of illness, disability or your age
        the care you need is not available or affordable in the country you live in
        the person you’ll be joining in the UK will be able to support, accommodate and care for you without claiming public funds for at least 5 years
        you’re 18 or over


        In Appendix 1 Form, can't she comes via Option 3

        Does the child need 24 hours care and help with dressing bathing and living and long term care? If the answer is no, then this route doesn't apply.

        Child of settled parents of appendix 1 refers to children under 18.

        What will be other Options for this child to join their parent. As now mother and other kids will be going to Join husband in UK, so how can this child stay alone. What other category she can apply to join their Parents.

        Child is 21. She is still living with her mother in Pakistan. Until now only Father is in UK and British Citizen. His Wife and other Kids are applying now to join him in UK but this one child is Over 18 which is an issue.

        Mother and her Kids don't have Visa, they are applying now for Visa to Join the Husband who is British Citizen in UK. So don't know how to sort out the issue for this child now who is over 18.

        I am sorry to say that they have simply waited too long.

        She could possibly go on a student visa (expensive) but that alone does not lead to settlement and she would have to rely on the existence of a post study work permit at the time she is done with her studies and being sponsored by an employer afterwards - a lot of ifs and buts.

        Otherwise she would be seen as an adult who should be capable of living on her own, if the parents decide to move abroad. I know, this is not culturally compatible with Pakistan but that's what it is.

        Thank you, yes even the plan is that she just get visa now and then go back to Pakistan as she is studying Medicine there.
        so might be in that case she has to wait longer and once finished studies can come as student, but that will be a bit hard to stay away from parents for couple of years.
