Spouse Visa Financial Requirements?

Post by dan883 » Mon Jan 04, 2021 7:19 pm

Dear Members
I appreciate your kind responses.
I’m planning for spouse visa for my wife after April 2021 who is abroad now. Got married in June 2020 after getting my ILR in Sept 2019. I was abroad from Feb 2020 to Sept 2020 and didnt have any income.

Started working from 01/10 /2020 as self employed getting gross income of at least £700 a week in bank. And this will continue upto at least December 2021. If I submit my tax return after 6th April 2021, with a profit of over £12k will I meet the financial requirement for my wife to apply her spouse visa?

Please advise.

It is NET PROFIT that is counted towards the financial requirement after all expenses have been deducted.

So if my profit is £12k in 6 months does my wife qualify ?

The requirement is £18,600 and not £12,000 so you need ensure you have earned that threshold in your most recent full financial year.

Hi thanks for your reply. I started working from 01/10/2020 only. When do you think I can apply for spouse visa then ?

It's obvious that your net profit for the financial year coming up won't be enough to meet the financial requirement. You are better of finding a job which can earn you enough income to meet the requirement faster than self employed because you need to rely on financial year but the current one coming up won't be enough.

I just realised that I made 3k from the employment that ended in July 2020. And I started self employment in Oct 2020. I can comfortably make a profit of £16k by 5thApril 2021. Can I show combined income on my tax return and apply for the spouse visa. It’s so confusing.

Income Threshold Query

Post by dan883 » Fri Mar 12, 2021 11:39 am

Hi guys
Thanks for your continuous support. I’ve got ILR Status and needed to apply for my wife’s spouse visa.

Income
April 2020- July 2020- £3200
UC claimed for Sept - £550
Self employment started from 01 Oct 2020
Profit for 2020/21- over 18600. Therefore the tax return for 2020/21 will have taxable income of over £20k as I’ve been putting over 90 hours every week.

Can my wife apply for spouse visa after April 2021 or does she need to wait upto Oct 2021?

Any suggestions is highly appreciated.

Kind Regards.

hi Dan,
I'm kind of in a similar position to you, although i do meet the threshold, please be aware that being self employed aswell i was told that everything has to marry up to your bank statements.
The predicament im in is that my books and reciepts show my earnings but since i pay some bills in cash i never put them into the bank account and you must show that your earnings in the bank match the books, annoying since if i pay bills in cash i didn't put it into the bank just to draw it back out again.

As for you net income, you MUST show that you have a NET profit of £18600, anything lower than that will not be good enough, i think i read somewhere that you can get around that if you like £60k in the bank for at least 6 months but i don't know many that do.

I am doing my tax return with the accountant. The income is coming in the bank and sometimes I spend cash too. I’m sure the HO will not ask for every expense receipt. They are more concerned to see if the income is £18.6k and if the tax has been paid.

Even though I will have £18.6k in profit I’m not sure if my wife can put in application because I’ve not been self employed for a year yet.
