Undefined CoS query

Hi there,
I keep hearing from the job agents/employers that 'employer does not have sponsorship license'.
I have couple of questions:
1. I read in this website (https://www.workpermit.com/immigration/ ... ponsorship) about the undefined CoS. Does the employer needs to have sponsorship license to provide undefined CoS?
2. Is it possible for an employee to pay the defined/undefined CoS fees himself rather than the employer?
