Being sent overseas for 3 years by UK company while on HSMP

Post by Vayu » Fri Apr 29, 2005 11:09 pm

Hi all,

I am an consultant working for a UK firm and am on an HSMP which (fingers crossed) should be extended for 3 years shortly.

There is potential that I might be sent overseas by this company, which would be a great opportunity. Given that the secondment is likely to be for at least 2 to 3 years, my question is what happens at the end of my 3 year visa?

For all intents and purposes I still want to come back to the UK, but at that point I won't have lived in the UK long enough to qualify for ILR. What will be the options 3 years hence for someone in my position.

Make sure you get paid salary in the UK and pay your PAYE and NI contributions to the Exchequer.

I am afraid nobody will be able to answer this question, as all hsmp people have not reached that stage yet ..

Try to contact HO for clarification ...

hi dear Vayu,

I remember reading the FAQs a long ago, and it says, u need to to stay four years with a maximum time of 6 months out of UK to be eligible for PR. Thats the only thing and it clearly stats that even if u have been posted out by your employer, it would be considered as a time spent out of UK. But this i think will not affect your Further LEave to Remain Application, the only thing which will be affected ias your status, you will be on HSMP for a few more years. But who cares when u are getting such a worthy thing in your career, what do u say? adn what do others say?

Please read the old FAQs if u have them available soemwhere, or may be the online FAQs, where i had read this.

Though, as Alex suggests, better would be to speak to HO people.
