The impact of speeding tickets and time on naturalization applications

Post by iceman809 » Sat Feb 06, 2021 8:25 pm

I am very distressed now, I can apply for naturalization on Monday, February 8th, all the conditions are met and I am ready. The only one is that there was a speeding violation FPN three years ago on February 6, 2018. I paid a 100-pound fine and deducted 3 points. As of today, my driver’s license has returned to full score status, and I am applying for naturalization on Monday. I also disclosed it.
For three years I have been very careful that there is no violation. But at 7:15 yesterday evening I passed a section with a speed limit of 20 miles (THAMES ST A308). Due to the darkness and rain, I did not see the prompt to suddenly change to the speed limit of 20 miles. My speed was 25mi. /hr I can be sure it is not exceeded. But the flash of the SPEEDCURB speed camera behind me flickered suddenly and there were no other vehicles around. I think I might be breaking the rules. If I really receive a speeding letter, will it affect my naturalization application on February 8th? What should I do next? I have been in pain since a day. Please help me answer, and give me the most heartfelt thanks!

FPN alone is NOT a criminal conviction. As long you get a FPN and speeding points, you will be OK. Make sure you pay the FPN right away.
If the FPN escalates to court (very unlikely for 25mph) AND you are fined by the court, then you will have a criminal conviction.

Conclusion: Apply as normal on 8th Feb. In the future, if you get an FPN and speeding points declare that to Home Office. It will not impact your AN.
Your information should be accurate as of 8th Feb. In the future if your circumstances change, you can inform HO via email/post (assuming you would have given biometrics by then).

If your biometrics are pending till then, you can simply add a cover letter and add with your documents before submission.

In 2018 did you get points and fine via FPN or court?

First of all, I would like to thank CULLINAN. I have read many of your replies and comments carefully and provided us with timely and effective directions. Thank you again.
I got FPB and speeding points and fine and did not go to court in 2018. I have no more penalty points at this time.
I just want to be sure I don’t have to wait another three years to apply for naturalization if there is an actual FPN, correct?

Thanks and welcome.
When did you get ILR? Who told you to wait 3 years after 2018 in the first place for a FPN alone? If you did not get points from the court you had no need to wait 3 years!

Was it a FPN or a courts summons you got in 2018?

I got the ILR in November 2018, and my lawyer told the safest method (because I have a speeding ticket that expires for three years ago February 6, 2021) so I applied for naturalization on February 8, 2021. My 2018 speeding FPN ticket has never been to the court. I paid 100 pounds in fine and deducted 3 points.

Your lawyer wasted your 1.5 years!! You could have applied in Nov 2019.

Thank you very much Cullinan, my thinking is clear. I now pray that I will not receive this fine for 25mph.

Do not get any more FPNs though till your decision is made after this 25mph one (hope you do not get this either). You should not have more than 2 in the last 12 months ideally.

I don't think one speeding offence will affect your application even if you apply within same month. All that matters is if you had accepted it (if its your fault) and paid the fine in time. Unless/otherwise it went to court and you were convicted through it.

I have submitted my naturalization application online two hours ago, and now I am just worried that I will receive this speeding ticket in the next few days because I drove 25 on the speed limit of 20. Of course, if I receive The fine will be paid as soon as possible and will not be allowed to progress to the court

Questions about participating in Biometrics

Post by iceman809 » Fri Feb 19, 2021 10:59 pm

I have applied for naturalization online on February 7th and scanned and uploaded all relevant naturalization materials. An appointment was made to enter Biometrics at The Lansdowne Building in Croydon on March 4 and paid £135 Biometrics per person. Now I have two questions. Do I need to bring all the original documents related to naturalization information except passport, ILR and Appointment confirmation? What is the process with Biometrics? Thank you

Biometrics is just your picture, fingerprints and signature.
As far as i know you only need your passport and booking confirmation as ID - presumably you have uploaded all documents on the system.
Of course you are free to take all documents - UKVCAS are not Home Office advisors so they will not provide any specialist advice.
This is just my opinion as a member of this forum and does not constitute immigration advice.
Please do not send me private messages asking for advice.
