Tier 2 General Visa and ILR related queries

Post by abtan » Tue Feb 23, 2021 5:56 pm

Hi All,

I am seeking advise on my queries based on following condition.

1. I came to UK during August 2016 on Tier 2 General Visa.
2. My spouse and child came to UK during November 2016 on Tier 2 General dependent Visa (my dependents).
3. Spouse got independent sponsorship for Tier 2 General Visa during Oct 2018.
4. Child (now 12 years) continued uninterrupted as my Tier 2 dependent.

I am eligible to apply for ILR during July 2021.

Queries:
1. Can my kid apply for ILR along with me as he is my dependent considering his mother is still on Tier 2 General Visa.
2. If the kid cannot apply along with me then when is the earliest he is eligible considering above conditions.
3. How his Visa needs to be extended (Category) if he is not able to apply along with me in July 2021.
4. Can the kid only apply for ILR when both the parent are settled and / or applied for settlement status.
5. As my spouse shifted from dependent to main applicant within the same Tier 2 category, is their any possibility of considering the total time for ILR application?

Thanks,
Abhi
