Hi all, I'd really appreciate your input on this process as it's quite confusing for me. I need clarity, I will give a clear description of the situation at hand:

We live outside the UK

My husband lives and works in the UK and got ILR in 2019.

We have 2 kids born before this, one in 2017 (American) and another (not American) before ILR in 2019. They are both minors; below age 5.

1. Can the kids leave on a visit visa to the UK while their father files for their settlement in the UK?
2. Can the kids get their settlement visa outside the UK without the mother included in the application?
3. Can I as the mother apply under the kids after they receive an ILR? From abroad or can I do so from the UK?

3. The children will only be granted a visa if the mother is applying at the same time. You and the children must apply from outside the UK. The children will not get ILR and neither will you, initially. It will be a 2.5 year visa for all of you.

What if he's got his British citizenship, does this make any difference?
Do I need to write an English test exam for my application as well?

No it does not. It is still the same process.
Do I need to write an English test exam for my application as well?
Depends if you are from an exempt country or not. If not, then yes, you need to meet the English requirment at a minimum of A1 level.
