ILR 28days back calculation

Team,

As I know that subject mentioned topics has already been discussed intensively in this forum but still I am bit confusing about the calculation period.

As I am about to apply ILR process for my family(Wife+ 1x Children),I need your advice as per below mentioned time line.

1) Vignette entry -15.04.16 to 15.05.16
2) UK entry date - 29.04.16

Now based on the UK ILR visa guidance about the earliest date(28 days before the entry clearance/application submission) for ILR submission date , I am considering earliest date for my family to submit ILR application(SET-O) as 19.03.21.

Please advise.

What is their visa category route?

Hi,
Their route is PBS dependent Tier 2(My route was Tier 2 General). I got my ILR(Set O) and now planning to apply for my family. Detail about dates in my previous post is related to my family.

Date initial visa was granted is the start of the qualifying period.

Didn’t get the point here......is 19.03.21 would be ok to submit ILR application.....as I am taking reference of start date of vignette entry date which is 15.04.16.

So is this OK to consider Start date of vignette entry as base date to back calculation of 28 days...in may case 15.04.16

Thanks for the update.

One more query related to SET(O) application for my family.

As my family(Spouse + 1x child) 1st arrived here in UK on 29.04.16(Tier 2 dependent visa) and subsequently extended Tier 2 dependent visa on 16.10.18(visa period 16.10.18 to 14.11.21).

Now while applying for their ILR application(SET O),need advice on below questions-

1) Does the period of stay on which this application was based include any leave granted since 11 January 2018?

As their visa extended on 16.10.18,It seems that answer should be "NO".Please advice.

2) Have you had any absences from the UK during any leave granted since 11 January 2018?
Had a absence in july'18(20 days),April'19(5 days) & july'19(5 days) which seems to be OK and need to be entered.

1. You answer YES to the question. October 2018 is "since 11 January 2018", ie AFTER.

2. You must list absences after the October 2018 visa extension start date.

Thanks CR001 for your prompt reply.

for Q2, OK So i don't need to mention absence which happened during july'18 as this was before the visa extension i.e. Oct'18. that's fine.

So as per the rule,for these two questions,any visa extension after 11th jan'18 and any leave after the visa extension need to be refereed.
