Post by Vivianoseni » Sat Apr 24, 2021 3:37 pm

Good day,

Please I need help with applying for ILR

My entry clearance was 12/10/2017
I arrived in the UK on the 25/ 10/2017
My current visa expires on the 10/09/2022

Can I apply for ILR on the 10/09/2022 and not face refusal since qualifying period is 12/10/2022

Will document submission after 12/10/2022 qualify me

Kindly advice please as am torn between applying for an extension of my visa or applying for ILR

Thank you in advance

Useful to state what your visa route is as different visa routes have different rules!

Your qualifying period starts from your initial visa issue/start date, not the date of entry.

You can no sooner than within 28 days before that date.

My fist issue date is 12/10/2017

28 days will be 14/9/2022

My current visa would be expired by then 😔

I guess I have to apply for an extension then

Thanks

You wrote your current visa expires on the 10/09/2022, and 28 days will be 14/09/2022. That's very close. Check out a few of the posts about when to apply. You may be able to apply "early" but schedule the biometrics after you qualify.

Here's a post about someone with 2 months and 10 days gap. Their plan was to apply for an extension, then vary it.
indefinite-leave-to-remain/vary-tier-2- ... y#p1996873

and here's one about someone applying just before becoming eligible:

indefinite-leave-to-remain/ilr-cefr-c1- ... n#p2004664
Apply on 29th April 2021 or even now (in your case) (MUST apply before current visa expiry) and book biometrics after 2nd May 2021 (which will be the case anyways as the biometrics run at a 28 day lag normally). As long a decision is made when she qualifies, she is fine. A decision can only be made after biometrics.
