This thread is for anyone who has recently applied for FLR and failed, or if those who are about to apply and do not meet the required points. And, those senior members who can offer advice to them.

I am in the 1+3+1 group and so far everyone who has applied for FLR has received it. I think this will change as the bullk of HSMP people start hitting the four year mark.

Do you mean this link is for those who have applied for flr and was succesful or refused?
You say that till now those who have applied for flr have got it, is that what you mean, pls clarify.

what is the time period of FLR applications these days? Has someone been rejected for not sending the approval letter as nowhere in the guidance or documentary evidence it is mentioned that we need to send the approval letter?

dear all
my friend applied FLR under old rules and regulations i mean filled in forms under old rules showing only be a ecconomically fit they sent the forms back to him but he sent again same saying that he came to this country under old rules how he can be forced to show new factors to be fulfilled so
home office sent him a letter to apply within 06 months again for FLR SO its mean they have given him the six 06 months time for further preparation etc. it is somehow ok for him but deciding to go to the court at the end if they would not accept the old rules criteria for him at the end............

Hi,

I am on a work permit and have received the HSMP approval. I would like to apply for FLR(HSMP). Can anyone suggest how much time does it take to process FLR?

Do they contact current employer for verification?

FLR received at HO 31st Jan
Direct debit deducted around 11th Feb
Received reference by post 18th Feb (letter dated 8th Feb)
Hotline currently says applications received up to the 4th Feb being processed.

Rang immigration today 20/02/08 saying my FLR request was now urgent(employer wants me back at work asap), should I fax urgent request form - and they advised caseworker had made a decision today on my case could not tell me the outcome. Passport and docs to be dispatched tomorrow. Fingers crossed, so over waiting and worrying.

hey guys, does anyone know what reasons there might be for rejecting someone's HSMP(FLR) application? I mean apart from logistical errors such as incorect specs on passport photos or form incorrectly filled out etc.

Hi John,
I have recently got the Tier-1 (general) Visa from india ,valid for 3 yrs & active since 1st June,08. I was just willing to know , how long can I stay in india without hampering the FLR and ILR in future ? I read somewhr that for ILR , I cant spend more than 45 days/1 month outside UK within 5 yr period ..any idea pls ?

After 4 years of being in the UK I today got a letter from the Home Office regarding my application of further leave to remain (FLR),, Guess what!!! .. Negative.. Rejected..

When I opened the letter this evening I was very positive because due to my current financial position I could never in my worst dreams have thought that my application would be rejected.

To tell you guys about my position how I came to this country and how I performed during the last 4 years here is a brief:

I landed in this country in June 2004 with a permanent employment with a reputed company paying me salary of £36,000. Then, I got on and started my own company in 2006 which had a turnover of around £91,000 in 2006-2007. I bought a house in 2005 which is worth now 325,000. My spouse got a job after 6 months of coming to the UK and was earning a decent salary. We had a daughter in Feb 2007 and after a years gap she has got a job worth £40,000. So i.e. we are doing pretty well.

Our visa was expiring in May 2008 and we applied on 15th August 2008 under the Tier 1 category for HSMP. Today I received the result of my application and guess what it was rejected… I was shell shocked and could not believe it. The letter I got stated the following:

Previous Earnings: Points granted 0 but should have been granted 45
I had claimed 45 points under this category because my earnings were way above £40,000. According to there reason why they granted me 0 points was because of the following:
o They were trying to match the net profit of the company (which I claimed as my net salary) with total net Invoice figure which was above £90,000.
o Second reason they gave me was that the figures shown in the Invoices do not match with the credits in my Personal Bank Statements (Funny How will my personal bank statements show my company statements)

For this category I had submitted the following two document:
o Company Accounts for year 2007-2008
o All the Invoices which I received from my Client during that period.

UK Experience: Points granted 0 but should have been granted 5
The reason they gave me was that since I did not get any points in Previous Earnings I was granted 0 points for this category.

English Language: Points granted 0 but should have granted 10
Even though I had qualified for this category in 2004 when I had submitted the relevant documents from my University and also checking it online on their website I was granted 0 points. For your information I did my Bachelor’s degree in Business Economics from Delhi University and they gave me 30 points for Educational criteria. Still they did not give me relevant points for this category. Strange isn’t it…

Well after this long write-up.. I don’t know how many guys I have bored but still for the people who are interested and guide me what to do next here are my following options:

- Appeal – They have sent me the forms how I can appeal
- Leave the Country – Voluntarily
- Apply Again

I would love to hear from people who have experienced a similar situation as mine or who can guide me what to do next. I need to appeal within the next 5 working days so would appreciate if someone can guide me how to appeal.. whether through a Lawyer or on my own… If someone knows about any good lawyers who specialise in HSMP appeals it would be great….

As per the recent JR (for hsmp extension) judgement, they should not reject your application. Please reapply with latest judgemtn copy.. look in other threads for more info.

Hi,
Normally HSMP visas are issued 2+ 3 or 3+ 2 years and then indefinate leave to remain in UK. i am wondering if someone delays entry into uk on HSMP visa and cannot meet the minimum required period of 4 years and 11 months to be eligible to apply for indefinate leave to remain then what to do? do they give second extension if one falls short to achieve that period after first extention? I mean 3 + 2 + some extension?

Hi,

This is the case with most ppl.

I think we'll have to apply for another extension before we could apply for ILR. There is no other way as far I know.

Do they really issue another extension? I did not find any details on this. will be thankful if anybody can provide more detail on this?

i am in 2+3 yr scheme. Now what is my option for ILR, if I stay away from UK for 1 year in between. shall i apply for another extension to complete 5 years in UK before applying for ILR? any idea how long that extension be? 1year?

Application refused based on company account!

Hi great people of this forum - pls help with advice I am in same dilema that "hello_aman" was then in 2008. If I had seen his posts before I wouldn't have fell into same situation.

HO just refused my application for extension , and my visa has expired.

Reason was they could use my limited company account of April 2008 -March 2009 for my earning . I submitted invoices till June with payment notification slips from the clients but they said they could not use it as no bank statements were submitted . company bank statement , howver is not part of the evidences they wrote in the guide for acceptance.
They also said they could not match figures in my accountant letters with the amount I claimed in a cover letter.

I am given the option to appeal , please what is the best way to go about this ?

So much is at stake here - mortgage , family, job etc .

Pls help!

Hi Aman,

It was recently that i came to know about this forum but was too late by then, i am is a same situation as you today received my pp they have refused and given me appeal forms.

they were not able to verify my previous employer and so they have not taken count of 5 salary slips and hence they have awarded me 35 points instead of 40.

what should i do now please help.

can i put in a fresh application, so that i get the result on the same day as i have all the documents.

They were not able to verify my previous company as it is under the process of liquadiation, and there is no contact number for that company.
I can get letter from the accountant and also from the company director .

I am stressed mate pl help i am 2 dependents, my son is under special education needs and has got a statement from the council will this help.
