hi my husband's visa expired 3 months ago i am in the process of filling out the application form now at the time it was expiring i was abroad and my hus didnt know wot to do so he just carried on living normal he did the test and passed but then we had a lot of family problems and we didnt send the form. can anyone tell me wot will happen wil he be asked to leave and apply from his country?? also i had a baby and was claiming child ben and tax credit etc the problem is i was advised by my friends to apply as a single mother as my husband is not entitled to any public funds!! in the MET form it asks whether i am claiming those benefits i dont know wot to do now?? can anyone help me with this dilemma i go back to work next month so i wil be able to support myself and my husband also works but i am just worried they wil find out i claimed as a single mother when really i was not!!!

A perusal of the Claiming Benefits section of this Board will show that it is totally OK for you to be claiming Child Benefit, and for you and your husband to be jointly claiming Tax Credits. But if you have been claiming Tax Credits solely, and but disclosing your husband's income, sorry that amounts to benefit fraud, if you have been receiving more Tax Credits than just the "family element" of £545 per year.

Expired 3 months ago! Ouch! This is really not good. For starters. your husband has no legal right to work! His employer faces a penalty of up to £10000 for continuing to employ him.

Your husband's home country .... where is that?

Fraud!!! that sounds scary and i never intended to do such a thing how can i correct this? my husband is originally sudanese but he came from saudi arabia where he used to work.

if you try to apply as an overstayer, it will take a very long time to sort it out and like john said, he shouldn't be working.
he should tell the employer he is going on vacation and see if you get lucky with a quick approval

Depends on where he has to go and if the new rules since October will cause problems. I would recommend a professional consultation first.

thanks so much for all the advice given and i do believe i need to get a lawyer but does anyone know wot the costs wil be for a lawyer?? thanks alot once again.
