EU Settlment Scheme non EU, in uk after December 2020

Dear All,

I am a non eu and currently arrived in UK on March 2021.I am holding a Fiancée visa valid for 6 months (not a marriage visitor Visa). My Fiancée is eu and has ILR settled status in UK. Our Marriage is on 05 June 2021. Can I apply for pre settlment via EU route after 05 June 2021 or can I only apply for normal UK spouse visa. Kindly assist.

Normal spousal visa, as one of the requirements for a Pre-settled Visa is that you were the family member of an EEA citizen resident in the UK (i.e. that you were married to the EEA citizen) before 31st December 2020.

EU Settlement Scheme is applied outside the UK which you qualify provided your EU spouse was resident in the UK before 31/12/2020. However, I believe you still qualify to apply EUSS from within provided ur EU spouse have applied for either Pre-settled or Settled Status in the UK.
