Tier 2 to ILR

Post by Fatimajafri » Wed Apr 28, 2021 1:14 pm

I came to UK in July 2016 & will be completing 5 years in July 2021. I am applying for ILR in May, 28 days before 5 years completion of my visa issue date. Can someone please answer these queries:
1. I went on maternity in 2017 & I am currently on maternity. The letter from sponsor should specify the salary before & after each of my maternity?
2. I understand I have to provide pay slip & bank statements before start of my current maternity leaves & the latest ones. Do I need to prove anything about maternity leaves I took in 2017?
3. All my leaves outside UK were for holidays only. My company will mention it in the letter about the dates I went outside UK. Do I need any other evidence of absences?
4. My current salary is above salary threshold for my skill (It is in SOC). However I enrolled for company shares & childcare vouchers which reduced my monthly salary. It is shown clearly on my pay slip. Will this affect my ILR application in any way?

Thank you in advance.

Applying for ILR while on maternity

Post by Fatimajafri » Wed May 05, 2021 1:59 pm

I am currently on maternity leaves & will be applying for ILR from Tier 2 ( General ) visa. I have a letter confirming my maternity but that is dated before the start of my maternity leaves. Will this be acceptable considering I will give my payslips & bank statements before & after the start of my maternity?

Also, I went on maternity in 2017. Should I give letters & birth certificates from that time as well?

I would highly appreciate a response. Thank you.

Tier 2 does not exist anymore. It is the skilled worker visa.
Read the guide as it tells you what is expected: https://assets.publishing.service.gov.u ... 2.0ext.pdf

ILR continous period

Post by Fatimajafri » Wed May 05, 2021 10:37 pm

I came to UK on 02.07.2016. My initial visa(entry clearance) was valid from 22.04.2016. I couldn't tragel on this and applied for a replacement brp. This new vignette was valid from 22.06.2016.
Now when I want to apply for ILR I'm counting 28 days before my second vignette validity date, that is 22.06.2016. Is it correct or should I count 28 days before first entry in UK?
Visa type was Tier 2 (General) at that time, now skilled worker visa.
Thanks a lot

You should use the initial visa issue date, not the replacement vignette.

Thank you Zimba fir your response. So you reckon I was eligible to apply for ILR 28 days before 22.04.2021? Is it ok to apply now considering my current brp is valid till May 2022

ILR for main applicant & dependant

Post by Fatimajafri » Wed May 19, 2021 11:36 am

I am applying for ILR along with my husband. I am the main applicant & he is my dependant. We are on Tier-2 General visa.
Is it ok to use Set(O) & apply together? Also as a proof of cohabitation, I want to give our joint bank statements. Should I give for all months of the last 2 years & is it ok to give online, pdf versions?
Please can anyone confirm if these documents are sufficient as proof of cohab?
1. Tenancy agreements
2. Council tax bills
3. Credit card bills in both of our names
4. Our pay slips with same address
5. Utility bills (some are in his name only)
6. Joint account statements.

Many thanks is advance.

You can apply together. The online version of documents is fine. Any evidence can be used

Submitted application one day earlier

Post by Fatimajafri » Tue May 25, 2021 11:03 am

My entry clearance validity is from 22.06.2016.
Brp was valid from 17.06.2016.
I counted 28 days before 22.06.2021 to apply for ILR. I wanted to apply on 25.05.2021 so I submitted my apply at 12.20 midnight yesterday. But I just found they work on GMT not on BST.
Should I withdraw my application or is it ok to go ahead with it? I read they can count 28 days from the date of decision too. So I should be safe ? ?
Please help 🙏

The date of application is not that important as the date of the ILR decision will take priority :!: DO NOT withdraw

Applying with spouse

Post by Fatimajafri » Wed May 26, 2021 4:35 pm

I have recently submitted my application along with my husband.
Now while uploading documents, it gives similar options for both of us. Do I need to provide documents in each of the categories? Like it is giving an option for Employer/Sponsor for both of us while I'm the main applicant. Do I need to give any document for him as well?
Also for cohab, should I upload all documents in 'Evidence of Residence' folder for him only? Or should these be in both of our applications?
Appreciate your help & guidance

indefinite-leave-to-remain/uploading-yo ... 96002.html

The categories are generic. Just follow the checklist and upload documents where they fit the best. Not all categories would apply to you.

Thanks a lot for your response.
The cohabitation documents should be uploaded for both of us or should I upload only in his application?
Like joint account statements, tenancy agreements etc.

Only the dependent needs to provide cohabitation documents not the main applicant.

Mistake in online application submitted

Post by Fatimajafri » Wed Jun 02, 2021 1:10 pm

I have submitted online application on 25th May & have my biometrics appointment on 21st June.
I just realised I misunderstood a question for my spouse. It asked "Have you had any absences from the UK during any leave granted since 11 January 2018?"
We did go on a holiday in January 2019 but our leave was granted after that holiday so answer should be No. But I answered it Yes & gave details of all absences even before 2018.
Will it be a problem?

Not an issue. If you had any visa issue after 11 Jan 2018, then the correct answer to that question is Yes
