ILR Dependent visa processing - Spouse & Child

Post by pradeep0468 » Tue Jun 01, 2021 4:45 pm

Hello Gurus,

I have Received my ILR through Tier 2 General Visa in Nov 2020(2015 - 2020). Now I would like to process UK visa for Spouse and Children (Born In India)

Currently they are in India and not holding any valid UK Visa.

Query:
1. What kind of visas do I need to apply for my wife and Children?? Will the same application will do for all 3 ??
2. Did my Children are eligible to apply directly - ILR as my dependents ??

Request moderators team experience and suggestions over this issue.

Thanks in advance.

Regards,
PS

1. Spouse and child visas.

https://www.gov.uk/uk-family-visa/partner-spouse

2. No they are not. They will get the same visa and follow the same visa route as your wife.

Dear CR001, Thanks a lot for your quick response.

I have gone through the link and other details, Please see the below details provided in the same link and can you assist me on this information for children.

Apply as a child
You can apply for a family visa to join your parent in the UK.

You may not need a family visa if at least one of your parents has indefinite leave to remain or proof of permanent residence. Check if you can apply to settle in the UK(https://www.gov.uk/settle-in-the-uk).

That only applies to a case where BOTH parents hold ILR or are British.

This is clearly stated when you go through the link you have provided, see below.
You can apply as a child
You may be eligible for settlement (‘indefinite leave to remain’) if both of the following are true:

you live in the UK with both of your parents
both of your parents are either British citizens or settled in the UK
It does NOT apply to a child who has a patent who is applying for a visa to join family. The child has to follow the same tribute as the parent applying for a visa.

There is no shortcut for the child.
