My card was received 2weeks and 4days after the promulgation was given. If 28days is passed i see no reason why they are delaying your leave further as the Akinsanya case doesn't seems to be applicable to you because as it is you are currently without a leave to remain. Both Snooky's and Obie's advice are valid. The attached letter to the determination mentioned they have 14 days to sought appeal not 28 days. 14 days has now passed, the court clerk gave me the home office determinations team email to chase them my barrister gave me two separate emails too, allowed appeal team and refesed case management team. I’m still looking for the post decision caseworker teams contact. I’m about to copy all of them in the email. I got a very good job offer and I really hope HO doesn’t mess it up for me. just after my previous message an email came from court which was notice of appeal, so HO is challenging FtT decision to allow my appeal at Upper Tribunal. I think that is wrong. The Home Office has made an undertaking before the Admin court that people in your situation will be permitted to work pending the decision in the Court of appeal . Write and ask for COA permitting you to work. If they insist on not giving you one, send the Consent order before the court and threaten JR, and follow it on.
I am just wondering, what’s the HO supplementary grounds of defence?????? It is ordered that:
1. The time for filing the Respondent’s Supplementary Grounds of Defence be extended until 12 noon on 12 July 2021.
2. Costs reserved.
Reasons:
Pursuant to the directions of Upper Tribunal Judge xxxxxxxxx issued on 17 May 2021, the respondent, if so advised, was directed to file and serve supplementary grounds of defence in
response to the applicant’s grounds of renewal, by no later than 14 days after judgment was handed down in Akinsanya. The written judgment was handed down by the High Court on 9 June 2021 and on 22 June 2021, the respondent filed an application seeking a stay in these proceedings at the Upper Tribunal, pending her appeal against the decision in Akinsanya to the Court of Appeal. For the reasons given in his decision of Xxxxxx, Upper Tribunal Judge Xxxxxxx refused the respondent’s application for a stay.
The renewed permission hearing in this case has now been listed. The respondent’s outstanding application of 25 June 2021 seeking an extension of time to file her Supplementary Grounds of Defence, is granted, as directed above. The Tribunal will be assisted by this document and subject to it being filed promptly, it can be placed on the court papers and be considered by the judge and the applicant (a litigant in person), in advance of the hearing.
