Need Help- HSMP dependent status

Post by vinodn » Tue May 10, 2005 1:07 pm

Hi Guys,
My friend came to UK on HSMP with family. He was a college lecturer in India, and still find difficult to get a job (after 3months)... meantime his wife, who is qualified teacher (primary and secondary) and came on dependent visa got a job in school...
If this continues and by end of the term (one year) if primary visa holder didn't get a job then...
1) How can dependent person stay in uk... can his wife who got the job switch dependent to primary.status ..or she need to apply for work permit...and suggetions...

Thanks

hi vinod,

SO far as i know, HSMP is a family work permit, i mean, in HSMP both, husband and wife are allowed to work, and at the end of first year, you should be economically active as a family, u must have survived and not taken any Governemnt help, regardless who earns and who doesn't.

SO, in your friend's case, he can find out some other job else then lecturer if he wishes and if he gets, in that case there will be absolutely no problem in getting FLR.

Seniors and HSMP Gurus may comment upon this...

While both the husband and wife are allowed to work, the onus is on the primary holder to be able to support himself and his family without resport to public funds. The family should not have to depend on the dependent's income to survive. It is advisable for the main holder to start doing any job to start with while searching for a job in his field.

this topic was covered recently, sorry i don't remember the exact thread though.

tell your friend to keep looking for a job and keep documentation of all applications, interviews, etc. at renewal time, they should be ok as long as they've been supporting themselves without use of public funds and as long as your friend has been actively looking for a job in his field.
