ILR on 5 yrs Work permit - please clarify

Hi,

I have worked with company X on Work permit from Nov 2003 till end of Sep 2004, worked with company Y on new Work permit from Oct 2004 till date (4 years) and still continuing to work. I got married 3 yrs back and have been living with my wife in UK since then.

Now planning to apply for ILR in Nov 2008 based on 5 yrs of Work permit SET(O) and I want to include my wife also for ILR as she is currently on dependent visa. I have been waiting all these years to apply for ILR and want to make sure that I do not make any mistakes in my ILR application

I have realised just now that our names are not registered with electoral register in our council for year 2007-2008. Where as our names are registered for earlier years (2005-2006 & 2006-2007).
Last week I have filled the electoral register form and sent it to my council and they confirmed they received it and will register our names for year 2008-2009 from Dec 1st 2008.


Can you please clarify the following questions I have so that I can take care of all these.

1) Shall I wait till Dec 2008 and then apply for ILR after confirming that our names are present in the electoral register? Does the fact that our names were present in electoral register for year 2007-2008 cause any issues?

2) Though I have not exceeded the 90 days holidays (outside UK) in the last 12 months, my wife was has crossed that limit. I was only away for 50 days in holidays in the last 12 months and 140 holidays in 5 years.
Where as my wife has 105 days in the last 12 years and 110 days in her last 3 years.

Does this cause any problem as I am applying my wife as a dependant on me in my ILR application?

3) I know both of us have to pass Life In UK test before applying for ILR. Can we take the Life in UK test any time now or do we need to take only 1 month before we apply for ILR.

4)What additional documentation is needed to show proof that we are married and my wife is staying with me for the last 3 years. There are not many letters which have both of our names. We have some council tax letters, and utility bills letters only.

I am planning to show Marriage Certificate, all her latest payslips, her offer letter, her bank statments and any other letters which have her name and my name as well. Will these be sufficient?


5) Finally, I am planning to apply for ILR at Croydon PEO office. Is there any website or telephone contact no to make appointment at Croydon PEO for applying for ILR.

Sorry for the legth of my post, I have been having all kinds of questions hence wanted to ask the experts before applying for ILR.

Using your numbering :-

1. This is not an issue. You are only on the electoral register, presumably because you are Commonwealth citizens. But you might not have been Commonwealth citizens, and thus have no right to be on the electoral register.
2. I don't think that will be a problem.
3. The test can be taken as soon as you and your wife are ready to take it. No need to delay.
4. You will also be supplying her passport as well, and that should indicate the time spent in the UK.
5. Yes, have a look at this webpage and see details of the 5 PEOs and the telephone number. Notice that the one telephone number covers all 5 PEOs, in the right-hand column. You mention Croydon, and that might be the nearest for you. But if not do go to your nearest PEO.
