Apply Visa for a child born in India

Post by nrcit7 » Sat Aug 21, 2021 11:40 am

Hi all,
Many thanks to all of you for, constructive forum.
I need some advice, our status is as below.

My status
I was granted ILR in October 2013 and received a Citizenship ceremony invitation in an email today (21/08/2021).
I am flying to India on 28/08/2021 and planning to come back in December. So I am planning to book a ceremony with the council in January 2022, as I do not have enough time.

Wife status
She was granted ILR in October 2020, and she is in India from November 2020 until now and planning to come back in December.

Baby status
Due to being born in September first week

We all are planning to come back in December, as I need time to apply for a passport and visa.
Could you please advise what visa I should apply for my baby?
And what is the process to do from India?

I really appreciate any help you can provide.

Regards
nrcit7

Apply separately
Which form you need to fill in depends on whether your parent has leave to enter or remain in the UK on a 5 or 10-year route to settlement as the partner of:

a British or Irish citizen
a person with indefinite leave to remain
a person settled in the UK - for example, they have indefinite leave to remain, settled status or proof of permanent residence
a person from the EU, Switzerland, Norway, Iceland or Liechtenstein who has pre-settled status - they must have started living in the UK before 1 January 2021
a person with a Turkish Businessperson visa or Turkish Worker visa
a person with refugee status or humanitarian protection
If they do, you must fill in the Appendix FM online form.

If they do not, you must fill in both:

the online application form
the Appendix 1 paper form
My opinions should not be constituted as an immigration or legal advice.

Morning TODMATT

Thank you so much for being so helpful, much apricated.
Would you please correct me if I am wrong?

I believe we fall under the below categories
• a person with indefinite leave to remain
• a person settled in the UK - for example, they have indefinite leave to remain, settled status or proof of permanent residence

So the form that needs to fill is Appendix FM online form.

To find out the types of questions and what document I need to submit, I started filling a dummy application.

In the Appendix FM online form, selected the process as Appendix FM Child

While answering the question, I come across a question below in “Previous Address History” section.
You must provide the addresses that you have lived at in the past 2 years.
    Is this a UK address?

What could be the answer, where a child born in India and at the time of application the baby will be a month old

The purpose of filling dummy application is to find out the documentation to carry with me to India.

    Regards
    Nrcit7

The form highlighted above is correct application form you should fill because both of you are settled and neither of you are not on 5 or 10 years route.

    Hi TODMATT,
Again I came across the same question regarding previous address details,

"You must provide the addresses that you have lived at in the past 2 years."

    Please can you advise?

I am a bit confused. Since you are now a British Citizen, won't your child be born a British Citizen, and thus be entitled for a British passport? And if so, won't you be able to apply for passports for both of you from India?

Edit: Sorry. Just saw the bit we you said that you won't be attending the ceremony yet, and I'm guessing that's probably what's causing the need for a visa.
