it makes no difference what the employer puts in the CoS as you have been in the UK for longer than 12 months
Your dependants can apply either now or at any time before their current visas expire. Their new visas will have the same validity date as your new visa

In simple term , Am I eligible to switch to skilled worker within UK under my circumstances described above ?
