question on being born here and overstaying

firsly, if someone was born here in uk 1984, but left uk at age of 3 to live in another country and returned to uk at age 16 and stayed since, studying and working and they are now 24, how would you suggest going about applying for a british passport providing they have a british birth certificate and documents to prove they was born here.


secondly, if someone who overstayed a visiting visa and has been attending college and uni for the last 7 yrs, is there anyway of them getting a work permit after completing the studies?

Do you know what the immigration status of the parents was at the time of the birth?

Both parents were on student visa and also was married here.

In that case I do not think there would be any claim to citizenship.

You need another two years legal stay before you can get ILR based on 10 years legal stay. This assumes you have legal entry?

If as your post suggest you do not have legal stay then another 6 years required.

As for a work permit - the answer is no. WP will disappear at the end of November and the PBS will take over. Without legal status in the UK you will not get an employer to take you on.

Is PBS gonna apply to family members? I still haven't grasped the PBS at all.
