Continuity Period - UK Absence while switching sponsors

Hello,

I am currently on Tier 2 General Visa for the last 5 years. I am about to file an ILR application and have query about the UK absence while switching companies. I'm worried about my Continuity Period.

In 5 years, I worked for 2 companies.

1st Company:

Actual Work Start Date : 02-Oct-2016
Actual Work End Date : 16-Feb-2018

2nd Company (Currently working here):

Actual Work Start Date : 12-Mar-2018
Actual Work End Date : N/A

From 18-Feb-2018 to 09-Mar-2018, I was away from UK for holidays. Should this be calculated as unpaid leave or any other way of mentioning it in absence letter. If it's unpaid leave, should it be against 1st company or 2nd Company?

Should I be referring to the Actual Work Start/End Date (or) Start/End Date in CoS (or) Date Of Issue/Date Of Expiry in BRP?

Any help/info is highly appreciated. Thank you.

what was the work end date in the 1st CoS and the work start date in the 2nd CoS?

What was the expiry date of your 1st BRP?

Was your visa application for the 2nd job in-time (before the expiry of your first permission) and in-country?

Hello,

Thank you very much for your reply. Please find below the answers.

1) 1st Company CoS | Work End Date: 24-JUL-2018
2nd Company CoS | Work Start Date:26-FEB-2018

2) Expiry Date of 1'st BRP : 07-AUG-2018

3) Yes, According to BRP my first permission expires on Aug 2018, I made the visa application for the second job on FEB-2018.
Yes, I was in the country when I did my visa application for the second job.
I only left the country after my 2nd visa application was successful and received the BRP.

Hope I answered all the required information. Please let me know if I have missed anything.

There is no need to do anything. Period of absence between employment count towards the 180 days and there is no need for any explanation

So just to confirm, the only place I will have to mention this absence period(between the employment switch) is the Immigration history of my application and NOT in any of the employer absence letter.

If you could kindly confirm this, It would be very helpful :)

Absence more than 180 Days

Hello,

I am currently on Tier 2 General Visa for the last 5 years. I am about to file an ILR application and have query about the 180 days UK absence. In 5 years, I worked for 2 companies.

1st Company:
Actual Work Start Date : 02-Oct-2016
Actual Work End Date : 16-Feb-2018

1st Company Absence (All Absence here are Approved Annual Leaves)

In gov.uk website, it is mentioned, if the grant of leave is before Jan 2018, then it is continous 12 month period and if after Jan 2018, it is rolling month Period.

In that case, my first company absence looks fine. But in second company absence, the count of top 12, totals to 185.

Is this an Issue to the application?
If yes, Should I make the Covid related as "Absences for serious or compelling reasons"?
If Yes, What evidence should I provide?

Any help is highly Appreciated.

Rolling means ANY 365 day continuous period, anywhere in the relevant qualifying period. Which 365 day period in your case goes above 180 days ??

Ah ok. I calculated the absence period wrongly. I'm well within the 180 days. Thanks for confirming on both questions.

Can I use my old CEFR Level C1 NARIC for applying ILR

While applying TIER 2 general visa. I got a NARIC letter (CEFR level C1) dated 23 AUG 2016 and the address mentioned in the letter has my old Indian Address.

Can I use this letter for below document requirement for applying ILR?
(Or)
Should I apply for a new NARIC letter (Visas and Nationality) ?

"NARIC letter that confirms the qualification meets or exceeds the recognised standard
of a Bachelor's or Masters degree or PhD in the UK AND confirm the level of English to
which the degree was taught or researched"


Any help is highly appreciated. Thank you.
