Naturalisation query - absence issue

Post by stevendublin » Thu Oct 28, 2021 11:46 am

Hi guys,

Thank you in advance for reading my post and possibly giving any advice!

So my partner is Irish citizen, I used Naturalisation Residency Calculator:

the Application date: 14/01/2022
Oldest stamp: 03/10/2018 to 21/09/2019 Stamp 4 354 days
2nd stamp: 27/08/2019 to 27/08/2022 Stamp 4 846 days
Reckonable residence No. of days: 1200

I was checking my passports, that the absence from the last a few years:
2018 4
2019 91
2020 29
2021 11

Do you guys think the 91 days in 2019 would be a problem if I apply on 14/01/2022? Like even if 1200-91=1101 days it would still be matching the target 1095 or 1096 days over 5 years? There is some emergency so I have to apply for it as soon as possible.

Could you kindly give some suggest if it is ok to apply like this? Sorry if some of my understandings of the naturalisation were wrong.

Thank you again!

I'm not a lawyer and this isn't legal advice, etc...

My understanding is that:
- Absences under 6 weeks in a given year are disregarded in calculating against the reckonable residence days
- Absences over 6 weeks in a given year are subtracted *in their entirety* (i.e. no 6 week "discount")
- You can make up absences over 6 weeks in a given year day-for-day by presence in the state beyond when you otherwise would have been eligible to apply

Given this, I think your math checks out, in that the only absence to subtract is the 91 days and you will have more than made up for that by 14 January 2022.
