Hi, I'm a wife of British citizen and have leave to remain. My 21 old son is my dependent.
The gov.uk says:
1. that children dependents can not lead independent life - I would like somebody clarify it
2. Can not have children, get married and live in independent unit.
It doesn't say anything that they are not allowed to work full time, on BRP says work permitted.
Moreover, I think I can add his income to meet financial requirements.
But, my lawyer insist that he is not allowed to work full time as in this case HO will not consider him as dependent. Is it right?

Working doesn't necessarily mean that child is leading an independent life.

I believe you are correct that you may include child’s income under E-LTRP.3.2.
(f) income from the sources at (b), (d) or (e) of a dependent child of the applicant or of the applicant’s partner under paragraph E-LTRP.3.1. who is aged 18 years or over; and
or under E-LTRC.2.2.
(f) income from the sources at (b), (d) or (e) of a dependent child of the applicant’s parent under paragraph E-LTRC.2.1. who is aged 18 years or over; and

Thank you, vinny for your quick respond.
I have read all topics you mentioned. Summary: the child dependent over 18 can work full time, he also may leave separate from parent home for work purposes and come for the weekend. But better to keep him registered at the parents address.
His income can go towards financial requirement if necessary.
The only my worry is that all those topics were about applying for ILR. I am afraid that I will have to apply to extend my visa . Will this apply for extension too?

The interpretation of “not leading an independent life” is the same for extensions and ILR.

spouse visa extension with dependent over 18

Hi, I have applied for extension on 5 years route with my dependent son who is 22 years old now. My application form and check list just ask general questions about him and doesn't ask to upload any documents to proof his dependency. Where all lowers say that I will need to proof that he is dependent on me . I am a bit worried if I did something wrong... My biometric appointment will be on Friday so I still have few days to change it.
Anyway, I uploaded two bank statements and letter on his name to proof that he lives with us, University diploma to proof his language, doctor's letter to show that he has a mental problems and covering letter where I explain that he doesn't work at the moment, has been just graduated, lives with us and depends on us financially and emotionally.
Is anything I need to do?
