returned to UK 5/12/2019
I'm English(European) my durable partner non EU used Surinder Singh having resided in Bulgaria, we both have BG longterm residence cards. We returned as visitors using McCarthy/Bangor rulings, a lot of people owe them a debt of gratitude so we thank them and may their God bless them.

Contrary to advice from Obie we tried to apply for PSS but failed because they demanded UK residence card or family permit, just as Obie said. so we had to withdraw 8/2020. Applied for UK card and got it 12/2020. reapplied PSS and granted 27/2/2021.
Not abusing system because we still might go back to BG if circumstances change.
As you can see by my join date it's been a 9 year journey, so never give up folks.
The reason for my post is to give a heartfelt big thank you to the admin and guru's for the help and support given to myself and so many others.
I am not a forum GURU, I am often wrong
Dont take any notice of anything I post, I'm getting old and havn't the foggiest what I'm talking about.

Can this be right?

My wife was granted settled status on January 10th. Having not received a new residence card reflecting this status, I got in touch with my MP, who has been told by the Home Office that:

"[My wife] was previously issued with an EEA residence card on 13 October 2015. She therefore previously held a BRC and did not qualify to automatically receive a new one following her grant of settled status. We would therefore advise that she applies to replace her expired BRC with a new one reflecting her status under the EUSS".

This application requires that we send yet more supporting evidence to verify who we are, and attend another biometrics appointment (despite this information already being on file). What's more, said appointment, according to UKVCAS, costs in excess of £100. I thought this whole thing was meant to be free?

Has anyone else had an experience like this? For info, her application was made on 16th September 2020 and COA received on 24th September 2020. Supporting evidence was returned this February. At no point during the process were we made aware that a new residence would need to be applied for, although I now understand that "Where an applicant is not a European Economic Area (EEA) or Swiss national, and has not previously held a BRC, they will be provided with a BRC upon being granted status under the EUSS". Surely that's discriminatory?

Any help/thoughts would be much appreciated.

2-3 documents per year is good. I did submit 5 a year. These covered council tax bills, letters from NHS & GP, Bank Statements etc. When the BRC expires a new one is not automatically issued. My mother will have to enrol for biometrics again for a replacement BRC. If the BRC expires while the application is in progress, it is possible they may issue a replacement BRC if the application is successful.
In the covering letter :
Small introduction regarding the applicant.
How the relevant requirements of the law are met.
Dependency on the sponsor
Relevant supporting documents submitted.
Finally a small conclusion

Hi forgive me if this has been answered on here but I am a British citizen and my wife is from India. We lived in Ireland where we exercised treaty rights and have been in the UK for 5 years. Her RC expires next month and we are applying for the paper form EUSS.

What I would like to know is how would the delay in application decisions affect her status to work in the UK? (as her RC expires next month) and also (I will probably find this out when the form arrives) but do they ask for all the documents which we submitted when we applied to come to the UK 5 years ago? Or are they only interested in evidence from when we arrived in the UK?

Im getting various snippets of info online and via a telephone conversation with them so I am reaching out to all of you for any assistance you can provide.

Many thanks in advance

I have a question if someone can help me please. I have been living with my British partner for the past 7 years in England, we went to Ireland 5 years ago for his work basis and moved back to England after a short period of time. Then last year through surinder singh I got a visa for a year (BRC card). Now in December I reapplied for a pre settled status however during Covid-19 we have many personal issues and have now split up. Today I got a reply and now they’re asking me for my ex partners passport however because of our break up I can’t provide this now. Would home office still give me a visa or not? As this breakup was beyond my control, Covid-19 really brought the worst out of us and led to separation. Can someone please guide me?

For those needing a paper application form. Looks like you no longer need to contact resolution centre for the form.

Hi,
i think the only way that the HO can check you're still together is ask you to provide your partner's original passport, myself i did send it to them.
i wish you the best

Hi,

Does anyone know what the current approx return time for the applicants passport is for a Surinder Singh paper application? Seen some older timelines ranging from 2-6 weeks?

Application arrived at the offices monday 22nd of November and we are hoping to travel in time for christmas, unfortunately we were messed around by home office for 2 months on the family permit, it was decided in September but due to a mistake qt the home office we only received it last week! Booked our flights for christmas thinking we would have had 3 months to get passports back!

Hi,
Please I need an advise I applied for Settle Status under Surinder Singh in June 2021, I am yet to receive any response from the home office after my biometric. Moreso my leave to remain on the 10 year rooute is about to expire. I want to know If I apply for my leave to remain as a parent of a british child will not nullify my previous Application of settle Status under Surinder Singh. I will be glad if you can advice me.
cheers
