Universal Credit

Post by businessmanuk » Tue Dec 07, 2021 4:01 pm

If me as a british citizen apply for universal credit or child benefit, does that effect my wife's spouse visa at renewal in any way? Also, does that effect if i were to sponsor adult parents as well? thanks

The cash savings you said you were using to sponsor your wife and your adult dependant parents, are too high to claim Universal Credit. UC is for those in need as they cannot keep themselves.

My situation has changed since then, therefore the need for UC. If the situation changes again in the future where I can support wife and parent, would it be a problem if I were to claim UC now?

You might be affected by the Deprivation of savings/capital rules.

No idea. Others might know.

At the moment, your NRPF partner must be linked to your Universal Credit claim but you/she cannot take extra money for her as Universal Credit is Public Funds.

If renting, joint tenants can be a problem with UC

If you are still self employed, there is the MIF (Minimum Income Floor) with Universal Credit.

IF the adult dependant visa is granted (you have been told of the pitfalls before) they cannot take public funds as you will be keeping them for 5 years.

Child Benefit must be claimed in your name only but your wife will need to be linked because of the earnings cap.

Claiming UC where entitled to wouldn’t affect a future application, claiming council tax support could. However, if you applied under Appendix FM with savings what’s happened to them? What have you used all those savings on?

I didn't apply for them yet, just asking if I were to apply for future applications as I have been advised for risk of refusals by many advisers.

You still haven’t said what happened to the savings, which is an integral question for any universal credit claim.
