Non EU marrying EU while on stamp 1g

Hi Folks,

Asking on behalf of my friend. She is Spanish national in relationship with Non Eu guy. The guy is on Stamp 1g second year. If he don't get a job with work permit he might have to go back to his country next year. Both are thinking of getting married next year before his visa expire.

Both are in relationship but not living together. Does this marriage will consider "Marriage of Convenience" by DoJ ?
