PBS Dependent visa

Post by shahjeev » Sun Dec 05, 2021 6:49 pm

Hi,

I am looking to apply for Tier 2 Dependent Visa for my wife, and need to have the updated guidance list. Currently, on the gov.uk site - the guidance seems to be withdrawn.

Can you please guide me to the latest guidance list.

Thanks,
Shahnawaz

Please do not tag PBS dependent visa questions to your ilr topic. It is not relevant in the ILR topic or sub forum.

She will apply for a Skilled Worker Dependent visa

Sincere Apologies for tagging this into the wrong topic and folder.

Actually, I am already on a ILR and wanted to know the guidance for ILR for dependent (my wife). Can you guide me a link to that?

Many Thanks,

You asked about an extsnsion, not ilr for her.

If you got ilr based in tier 2, she applies to extend her visa as a skilled Worker dependent. Search Google for skilled worker dependent visa guidance, it is the 3rd or 4th link to a pdf in the search

Thanks, and sorry for the mixup. Let me clarify again.

I want to apply for her ILR, as I already have the ILR via the Tier 2 General Route. Hence the guidance question.

Also, will it be SET O or SET M for her ILR (Dependent)?

Thanks again, and I will move my questions into relevant topic going forward.

SET O for a tier 2 dependent. It is the only form she can use.

ILR Dependent - 5 Year Continuous Residence Calculation

Post by shahjeev » Sun Dec 05, 2021 8:37 pm

Hello,

I am applying for my Wife's ILR as dependent to me (I already have ILR issued via Tier 2 General Route) and have a continuous residence question on below summary.

Summary of trips - (Apologies for the big list)

2017 - 5th March to 23rd March = 19 Days

2017 - 29th October to 24th April 2018 = 178 Days

2019 - 10ct October to 03rd Nov = 25 Days

2020 - 14th Jan to 03rd Feb = 21 Days

2020 - 16th Dec to 9th March 2021= 84 Days

2021 - 12th July to 22nd August = 42 Days

2021 - 24th Oct - 16th Nov = 24 Days

Questions:

1. Based on above, can you please guide whether she is OK with the consecutive + rolling absence period of 180 Days per year.

2. Total leave count during her whole 5+ year period is 393 Days, is that OK as well?

PS: She entered the UK on 11th Sept 2016.

Many Thanks in advance,
Shahjeev

Topics merged!!

What are all the visa starts/issue and expiry dates??

Tier 2 dependents have no absence limit if visa was issued in or before 11 January 2018. If a visa was extended/approved after this date, then there is an absence limit.

2nd Visa (Renewal) - July 2019 - Jun 2022
Only absence since July 2019 must be declared and meet the absence limit.

Thanks CR, so what you were suggesting is - I should only mention the absences from July 2019 onwards in the form? And that it will meet the criteria ?

Many Thanks Again

It's not what she is suggesting, it is what is correct. Only absences for visa issued after 11 January 2018 needs to be declared.
You have stated a visa got issued in July 2019 (this is after 11 January 2018) so only absences from the July 2019 visa is relevant.

ILR Dependent English Language Reference Question

Post by shahjeev » Mon Dec 13, 2021 6:43 pm

Hi,

I am ready to apply for my wife's ILR application (under Tier 2 dependent - SET O). She has passed the English Language equivalent to B1 or higher with Distinction. Her provisional results are ready, however the final results will be given in 4 to 7 days.

Questions:

1. Can I apply with the provisional result with the online reference number given - or should I wait till the final result is out? (Considering the online reference number will not change).

2. Does the Immigration start reviewing the application immediately after submission (even before Biometrics is given) or I assume it is after the biometrics is given?

PS: I am trying to speedup this, as need ILR submission for a job application.

Thanks in advance.

ILR Dependent Application Travel History Question

Post by shahjeev » Sat Dec 18, 2021 7:08 pm

Hi,

I am uploading the documents for ILR Dependent for my Wife. It has an option of Identity/Travel History.

Can you please guide me - what should I upload in that section? Do I upload tickets of all the journey's undertaken by my wife? or leave it blank? or something else?

Appreciate your help here.

Thanks a lot in advance.

Regards,
Shahjeev

Upload the ID page of her passport plus all pages with entry/exit stamps. This should corroborate her travel history list given in the online application.
