Absences - citizenship

Post by britspouse15 » Mon Jan 10, 2022 8:33 pm

Hi all,

I wondered if anyone could advise me.

I am british - my spouse got her ILR 26/8/2019 - we are seeking to get her a british passport but are concerned regarding her absence and the chance of being rejected.

In the last 3 years she has been absent 385 days.
In the last 5 years she has been absent 501 days.
In the last 12 months she has been absent 22 days.

Guide AN suggests that up to 540 days (in route 6(2)) is acceptable in 5 years as long as you meet all other
requirements and you have established your home, family and a substantial part of your estate here.

She meets this I beleive as she has two children (both british citizens) who attend school in the UK and we live together in our home in the UK.

Does anyone have any experience with this?

Thank you in advance.

I should add she was in UK exactly 5 years ago today.

Dear britspouse15,

Did you apply for your spouse citizenship ? If so how did you overcome the excessive absence?

Thanks
