ILR Spouse Visa - Income Requirement

Spouse ILR - Is an interview a part of the process?

Hi guys,

I wanted to ask for the spouse ILR, is an interview a normal step? And under what circumstances may you be called in for an interview. Is it done at random, or are there specific factors that may contribute to it?

So far we've renewed twice without issue, we're meeting the income requirement, we live together with my parents (Soon we're buying our own place), we both work for UK employers and have been in the same job since our previous applications.

Ahh okay, thanks for the quick reply! I read somewhere that you COULD be invited for an interview? I assume that's in very extreme circumstances or if there's some discrepancy with your application?

Hi Guys,

I've got 3 questions;

1. If I change my job 6 months prior to my ILR application, would that be fine? Or would I need to show income for the past 12 months?

2. My wife can apply for an ILR in September, but her BRP expires in Summer of 2023, so does this mean we can apply for an ILR at any point between September - June 2023?

3. If my wife goes on Maternity Leave by the time of her ILR, will her income prior to the Maternity Leave still count towards the income requirements? So let's say she goes on Maternity Leave in May, her income will reduce drastically. Would we still be able to use her normal income prior to the maternity leave as part of our income requirements?

1. Yes it is fine which means if you have been less than 6 months with current employer, you will need meet both conditions of category B.

2. Yes, ideally you can apply 28 days before completing 5 years from the date of arrival or as some people do they saved up and apply late so you can apply anytime before June 2023.

3. She can use income prior before she went on maternity assuming she has been employed for 6 months with that particular employer.

I have another question, my wife is due to apply for her ILR in June of 2023. Is she allowed to apply for a joint mortgage with me? Or is that something we're prohibited to do? Does it have any affect on our application? Or is it fine.

I just wanted to ensure it has no impact on our ILR or if it breaches any aspect of our agreement pertaining to the visa as in what my spouse is allowed to do or not allowed to do.
