Early extension of tier-2 dependent if main appliacant gets ILR

Post by uzairzamansheikh » Wed Jan 19, 2022 6:06 pm

Hi,
My sister will get her ILR by around second week of March 2023 (as she will do the premium service, so hopefully it will take upto 10 days).
Her kids are tier-2 dependents and their tier-2 extension is due in Jan 2023, while they will be eligible for ILR in July 2023.
So the question is, can they apply for tier-2 extension for kids earlier in March 2022 (to extend it till July 2022) without waiting for Jan 2023 to get extension? And they will then simply apply for ILR in July 2023.

Thanks in advance.

Are you dates accurate??

Children can apply for ilr when both parents apply for ilr.

Sorry you are right, small mistake
“ My sister will get her ILR by around second week of March 2022”

My brother-in-law is not eligible for ILR until July 2023 and he will also need tier 2 extension in Jan 2023.

Three of her kids are and will be under 18 until July 2023 aswell.

So, she is planning to get her kids tier 2 extension done in March 2022 instead of waiting till Jan 2023, as she in need extension till July 2023 anyways.

She will need to apply for the husband too if his visa is going to expire when the children's visas do. If you apply for kids earlier in march 2022, they will still only get an extsnsion to the expiry date of your husband's visa if he doesn't apply with them in march.

They will all get a 3 year extension regardless of when they apply once she has ILR.

Thanks a lot. Very informative.

And what if she doesn't want to apply for her husband's extension (TBH he is not interested in coming to UK). So she is only planning to get her kids extensions done and later on ILR and Citizenship (when it's time).

Are you saying she can't apply for her kids without applying for her husband at the same time?

Thanks

Yes and the same applies for ILR. For citizenship, her children will qualify when she does or after she is British and her husband has ILR.

Apologise if I am not allowed to ask this here.

Do you know of a good lawyer who we can consult to do cases for these applicants?

Members are not permitted to post names and details of lawyers or immigration advisors on the forum.

Besides, a lawyers isn't really needed. The immigration rules are very clear.
