Is Tier 2 ICT eligible ILR after 5 years: April 2022

Hello All Seniors members,
I'm in Tier 2 ICT visa and came to UK before 2 years. I heard today that from April 2022, Tier 2 ICT can apply ILR after 5 years. Is this true? If yes then can I apply ILR after 3 years as I already completed 2 years in UK.

If true, then it follows from the recommendations.
The ICT route should become a route to settlement, without the need to switch to other routes to obtain settlement. Time spent on the ICT visa should also count towards settlement if the worker does switch into another route

Unless and until it is implemented in the Immigration Rules, it is just that; a recommendation from a committee to the Minister.

It will only be after the relevant amendments are made to the Immigration Rules that such an option will exist.

As the recommendation was only made in October 2021, I would expect it to be at least a few more months, for the relevant Statutory Instrument (SI) and application forms to be drafted, and for the SI to be laid in front of the two Houses of Parliament for the normal 28 days before the ILR option becomes available.

I am sorry for posting in someone else's topic, but I have a friend who is in the same situation as OP so it is relevant to the OP as well and he asked this already.

Is it likely that if ICT becomes eligible for ILR, it will be backdated as well (my friend spent 2 3 years already in the UK, so he would only need 2 more years).

Also, if he changes the job and gets sponsored as skilled immigrant, would he be able to use the time spent on ICT to qualify for 5 year period?

The general rule for ILR in five years time is that such ILR can be applied for after five continuous years in the UK On the same or similar visas.

So, for instance, ILR after five years Skilled Worker visa can include time spent in the UK on the Tier 2 General visa, for instance.

But time in the UK on a Tier 5 Youth Mobility visa or Tier 4/Student visa, etc , would not count towards a five year Skilled Worker visa.

It will depend on the precise langauge and wording the government uses when (and if) enacting the changes in the Immigration Rules.

Past pattern would suggest that time spent in the UK on an ICT visa will not count towards five year ILR.
