Tier 2 to ILR English Test & Public Funds

Post by peakdis » Mon Oct 04, 2021 11:27 am

Hi,

I am currently a Tier 2 general visa holder, have been working in the UK for almost 5 years and will apply for the IRL soon. I have some questions:

1. I still have my IELTS test certificate (with a score of 7.5) in 2017 used to apply for my first Tier 2 visa. It expired in 2019. Can I use this one for my IRL application? Do I have to take another test?

2. I understand that a Tier 2 visa holder cannot apply for public funds. I'm living in NI now and eligible to apply for the high-street voucher scheme. Will taking this voucher make a negative impact on my IRL application?

Thank you.

1. Yes if the test centre is still on the list
2. This has nothing to do with public funds

Applying for ILR with to-be expired passport

Post by peakdis » Sun Jan 09, 2022 7:55 pm

Hi,

We (my wife and I) be eligible to apply for the ILR in April but my passport will expire in Sept and hers in Dec. Our questions are:

1. Will we be fine to apply for the ILR with the current passports? I know some visas need the applicant's passport have at least 6 months before expiry, does the ILR requires something similar? My passport will have 5+ months left and my wife's 8+ months left when applying for the ILR.

2. My wife's BRP card is with the DVLA, so she will have to take the lifeintheuk test and english language test (both are happening soon) with her current passport. Will things be much more complicated if she gets a new passport after these tests?

Thank you.

Hi again, would you please advice when is the earliest date I can apply for the ILR?

My Tier 2 general visa was granted on 23-April-2017 and I arrived at the UK on 05-May-2017. Will the earliest date I can submit my online application be 28 days before 23 April 2022 or 28 days before 05 May 2022?

Thank you.

Thank you. So I can submit my online application on 26 March 2022 (28 days before 23 April 2022)? Can I submit earlier but book an appointment for document scan on a date after 26 March?

You are eligible to apply from 26th March, 2022. Date of online payment is taken as date of application. To apply before date of eligibility is your decision to make.

Re: Applying for ILR with to-be expired passport

Post by peakdis » Wed Mar 09, 2022 3:38 pm

Hi again,

I am preparing the documents needed for my ILR application. I had several absences from the UK either to attend work-related conferences or to visit friends. It is said in the application form that I should provide "Letter(s) from employer(s) detailing reasons for work-related absences including periods of paid annual leave from the UK and Crown Dependencies".

The absences happened when I was with my previous employer.

May I ask what exactly should be in the letter from my previous employer? Do they need to address the detailed dates and reasons for my absences in it?

Thank you.

May I ask another question (I am not allowed to edit my previous post)?

They ask me to provide "Evidence of immigration status in the UK". What is that? I thought it was the BRP card, but it's not as there is already an item "Current Biometric Residence Permit" in the list.

It is your BRP.
You will use same BRP to meet both requirements.

Thank you. I read from other posts that letter from the previous employer stating the reasons for absences is not required anymore. But I do see the online system asking me to provide such a letter. Should I just ignore it? If so, which option should I choose for the question "What evidence will you provide to support the reasons for all absences from the UK and Crown Dependencies?"

Thank you.

Rule changes, updates in guidance and online application forms appears not to be coordinated. Ignore it.
