Hello,
I am a British citizen since 2019 and got my citizenship through tier 2 visa. My wife and son who is now 22 years old are my dependents , and they are holding dependents' visa through 5 year family route /FLR-M. Both will complete 5 years on FLR-M/ family route visa in march 2023 and will become eligible to apply for ILR.
My question is my adult son who is now 22 years old, is now studying phD in USA in a university. He is emotionally still dependent on us and his USA visa is student visa (F1). I would like to know if his application for ILR status is going to be affected as he is studying in a foreign country? He will still be a student (of PhD ) at the time of application for ILR in march 2023. He gets stipend from university as a PhD student , will these two factors adversely affect his application for ILR status ?
