Job in another country after naturalization

Post by klick02 » Sat Mar 26, 2022 2:14 pm

Hi, probably this topic is covered here already, but I became a naturalized citizen last year. I have got a good job opportunity in UK. If I take it, will I have to submit the desire to retain citizenship form every year starting from now? Also, will i have to notify anyone?

Yes you will need to inform and send INIS an annual declaration of intention to retain your Irish citizenship. There is no other requirement other than this.

Does every Irish citizen have to fill out that form or only people who were naturalised? Can citizenship be taken away for leaving so soon after citizenship or for being away for a long time?

That is applicable for naturalized Irish citizen. On the relevant page it lists few conditions for your citizenship to get revoked and one of them is this one, if you don't let State know for 7 years by each year sending the form, there is a risk for your citizenship to be revoked.

This was discussed before briefly, I don't know if anyone lost their citizenship because of this, just stating what is written on the website.

just out of curiosity - what does leaving state mean.
if we leave for job but visit Ireland multiple times a year (because its home), even then we have to fill the form?
or is it only when you are absent for 7 years continuously?

The legislation uses the term 'ordinarily resident outside Ireland'. So if you work in a different country, that means you have taken up the ordinary residence there.

Since this part of the legislation was never ever used to our knowledge, or more importantly challenged in the court, it was never properly scrutinised.

The term 'ordinarily resident' can mean a few different things:

For example, Revenue states that if you have been working and paying tax in Ireland for 3 consecutive years, even if you leave the state from year 4, you continue to be ordinarily resident in Ireland for 3 more years, so you could argue that for these 3 years you do not need to send in any declaration if you use Revenue's definition.

For border controls, the rules are usually either 6 months or 9 months, depending on the status of the person. People who leave the country for more than that period of time may get their status revoked.

However, again, this is not defined in this part of the legislation, so it's up to both INIS and any potential challengers to challenge that definition in the court.

The only challenge with the form is getting it signed every year by some authority, like from embassy or smth. Apart from that it's 2 pages long simple form that asks for your naturalization details and your current address.

Is it the same for British citizen who got their Irish citizenship but living in the UK?

I would assume if they're British they have another way of being entitled to citizenship, such as FBR/Irish associations, and these people don't have to submit a form to retain citizenship, only naturalized people do.
