job creation and covid concessions.

Hi Great People,
I need your assistance regarding Tier 1 job creation requirements as per covid concessions.
I need to apply for extension in April 2022.
I have 4 full time employees 3 British) while 4th (on European Spouse dependant leave)
Employee 1:
has been on full time since last year till march 2022 he has been on payroll for total
14 months.
Employee 2:
Started full time work since july 2021 and till march 2022 , he has worked 9 months.
Employee 3 :
Started full time work since feb 2022 and till march 2022 , he has worked 2 months.
Employee 4 : European Spouse dependant.
Started full time work since Jan 2022 and till march 2022 , he has worked 3 months.

A: Using the corona virus concessions can i combined them all different jobs to make 24 months
2 full time job. ( 14+9+1) or (12 +9+3) .
B: employee A worked 14 months , 2 months extra than one full time job , can i add that 2 extra months with other employees to make another full time job of 12 months ?
C: can i use employee 4 in job creation as he is European spouse dependant ? if yes what are the ID documents required, only BRP is enough ?
D: what documents apart from ID , i need from my accountant for job creation as per my knowledge
1. Payslips , 2 . FPS .... is that enough ?

B: No
C: Depends if he/she has permanent residency. The BRP should have that information
D: if it is a business you started, then only Payslip and FPS

Q5:Accountant is in process of preparing the Unaudited accounts , not sure about the Account compilation Report, is that the part of the accounts or separate document ?

Companies House documentation demonstrating your business
involvement
Q6: what document is required to show my involvement in Business ?

HM Revenue & Customs documentation demonstrating your business
involvement
Q7: What HMRC document shall I have to prove that i'm engaged in business ?

Letter from an accountant confirming the job creation
Q8:letter from an accountant should only mentioned about the job claimed for job creation or All the jobs which were created during 3 years period ? )

It is job start date, so Jan 2021

Not applicable. This was for jobs created before RTI started - no longer relevant

HO needed original bank statements earlier. Self printed bank statements needed to be stamped by the Bank. I don't see that as a requirement any longer but if you have an original statement that would be better.
You do need companies house and HMRC documents - refer to the guidance document for more details.

As it says, whatever is needed to show the evidence. There are no minimums.

Read the guidance - it is quite clear in there.

You need this only if you have taken over an existing business. Not relevant for new businesses.

for now trying to check in policy guidance about the HMRC and Taxation docs, all other points are cleared now. :D
i'm preparing for extension application, hope all good, if there is any further info needed.

Hi Marcnath,

initially i have invested money with refrence of "Director Loan " , funds were tranferred from my personal to business account. Now the investment has been declared as a Share Capital on my name. As initially the investment were made with refrence of Director loan . while submitting the application i have been aske dto click the following :
[__] Business bank accounts (which you are a signatory of) showing
transactions
[__] A letter from the business's bank(s) confirming you are a signatory on the
account(s)); evidence to show business premises in the UK; and that the
business is subject to UK taxation
[__] For any investments made by Director's Loan since your application for
your initial grant of leave, the loan legal agreement(s), and where the
initial investment was made on or after 19 November 2015, business bank
accounts showing the investment(s)
[__] I cannot provide one of the above evidences
Explain why

Q: if the investment is declared by way of share capital now , do i still need to provide " Director Loan
Agreement " ? or its not mandatory now because of Share capital method ?

If it is now converted to share capital, there needs to be no reference to a DL at all in your application.

Hi Dear Mods, i made an extension application begining of April 2022.

I recieved this email 3 days ago
" A decision on your application has been delayed as we require further documents in order to process your application.
You have provided evidence in order to meet the 2 full-time jobs required for a Tier 1 Entrepreneur Visa. Unfortunately the documents you have submitted do not meet the requirements for the equivalent of 2 settled full-time employees as stated in the Immigration Rules. If you have any further evidence of employees that would meet the requirements stated in the Immigration Rules, then please forward this evidence to us.

Additionally please provide the following for the employees you have previously supplied evidence for:

Passport or BRP card showing right to work
Contract of employment "

i have few employees worked and working for my business during last 3 years i need to check which of
these can qualify for 2 full time jobs to meet the Immigration rules requirment for Tier 1 (ENT) extension.
and possibly from where i can count (claim) these jobs. what are the most suitable options.

The problem seems to be that there is a requirement that each job should have lasted 12 months. Only A1 and B satisfy that.

If you have been affected by COVID, you need to state that and use the exception granted for businesses affected by COVID when they relaxed that particular requirement.

As A1, A2 and A3 were doing the same job (role), can We not use A3 onwards when A2 left job .

Yes if you define it that way.
A1 as Job 1 and A2 and A3 doing Job 2. Then each has 12 months and can be combined.
