What happens when IRP expires?

I'm currently a Stamp 4 holder, ex CSWP holder. My Stamp 4 will be valid for 1.5 years more.

My wife has a Stamp 1G (dependent on mine) that expires at the end of this year.

We have an opportunity to go work in the US and I'm wondering what'd happen if we take that offer and it ends up going south and we have to return?

1) What would happen if my IRP is still valid but my wife's isn't? Would she be able to register again?

2) What would happen if my IRP expires? Would it be back to square 1 and try to get a CSWP again?

Your stamp is valid on the basis that you continue to be an ordinary resident in the state and do not leave the country for more than 3 months in a year. There are exceptions - family issues, medical travels etc. Any changes to your condition must be reported to INIS no later than 14 days after it happens.

Your wife's condition is the same as yours, with an additional requirement that she must live with you together at the same address in the state.

Failure to abide by the conditions may result in your stamps being revoked. It doesn't necessarily mean they will be revoked, but INIS will have the power to revoke them.

Of course many people leave and come and don't inform INIS. If you are lucky that the border officer does not find out, you should be fine as long as your stamp is valid, but there is no guarantee whether INIS will find it out at a later stage by checking your entry/exit dates.

Finally onto your questions:
1. If your IRP is valid but your wife's isn't:
- Assuming that the border officer doesn't find out you are in breach of your conditions;
- Depending on your wife's nationality - if she is a visa required national, she must apply for a visa before she can come to Ireland;
- If she is a non-visa required national, OR if she has obtained the visa, she can come to Ireland and tell the border officer that she intends to join you who used to be a CSWP holder. She will need to present all documents that can prove that you had CSWP before and now you are on Stamp 4 to the border officer. In fact, this may be tricky as the border officer may not be satisfied due to the fact that she used to have a Stamp 1G previously.
- She will be given a proper stamp by the border officer which allows her to apply for a new Stamp 1G with local immigration offices.

2. Yes you will be back to square 1. As mentioned above, in theory you should be back to square 1 after leaving the state for more than 3 months and no notice has been given to INIS.
