Spouse visa extension help required

Hi all,

I require some assistance with regards to my wifes application. She is here on a spouse visa. Her visa was issued 4th October 2019. She entered UK 29th October 2019. Her visa expiry and BRP expiry is 4th July 2022.

When can we apply for the extension visa? Can I also apply in late June as long as the application is submitted before 4th July 2022? thank you all

Thank you for the reply. I am planning to apply end of May or start of June.

When would she be classed as an overstayer? As in, is it if I apply after 4th July?

My concern is if I apply June and the application takes eight weeks for an answer. Would she be an overstayer or will this not apply as the application was submitted before the expiry of current visa? thanks again

If you submit application before 4th July She will not be an overstayer as you have made the application in time. She will continue to retain same rights as she currently has on existing leave.

Thank you once again.

I have a further question if you can assist me with please? My wife and I live with my parents. We have inidivual bank statements showing the same proof of address and my wife is named on a utility bill (water bill) alongside my parents. I am named on the BT broadband/landline. Apart from this we do not have a joint bank or any other proofs of address as we live with my parents and they pay all the other bills council tax etc.

How do I go past this step as I can provide my bank, wifes bank statements, water bill and utility bill but thats all? thanks again

Hi I hope you are well. I need some assistance if possible please. The current visa is valid for 2 years and 9 months as opposed to 2.5 years. Does this mean I can still apply before 4th July for her to not be considered as an overstayer? It says it needs to be applied 28 days before ? does it really need to be as in if I apply say 15th June or 20th June will she be classed as an overstayer? thank you once again

She only becomes an overstayer is the application is made AFTER the expiration of her current leave. Application can be submitted between when the 28days concession can be used and the last day of valid leave.

Thank you. If we submit but her biometric appointment is after 4th July which is when the visa expires is this fine?

For the first application I submitted a house report. As nothing has changed I don’t think it’s required. Just a letter from parents to say I live there and they own it etc.
