EEA PR REFUSED AFTER 11MTHS.

hi
my bro submitted his application for pr on grounds of separation in nov 2007, the ho asked for more doc in may 2007 and this morning wrote to say the app. has been refused bcos the wife id card has expired, my bro is no longer with her and when they asked for more docs he gave them anything that he could find, the lady has refused to co operate as she has a new partner.
what can we do?

his wife european union id card . she travels with her passport. and the id has always been among ignored books and magazines . my bro gave them that as he had nothing else.

he hasnt got a new partner, they only refused him today, he and his wife got separated march 2007.

Obviously you want to appeal. I think it cannot be expected that you produce documents relating to a former spouse - especially since the Home Office has certainly seen these before in previous applications.

The big question is: has he initiated the divorce, and has he received the decree absolute? If not, he is in a legal grey area. He still has a good chance in an appeal, but he should prepare it carefully and get a solicitor involved.

Casa , you ask about the new partner you think it is possible to divorce and get marraige again without getting your own right? what about if you get a new partner and your appeal was refuse what can you do with your new EEA partner ? Can you apply to get marraige again? would the allwo you?
