ILR Long Residence

Post by lomo » Fri Jun 17, 2022 10:44 am

Hi,

I obtained ILR through the 10 year route in 2021. I was in Tier 2 visa before obtaining the ILR. My wife is still in Tier 2 dependant visa which expires in Feb 2023. She is eligible for ILR through the 10 year long residence in March 2023. Because her visa expires before 10 year eligibility is met, she is planning to apply for a family visa now. Can she apply for 10 year long residence ILR in March 2023 if she moves to family visa now? Are there any other options? Your advise is much appreciated.

If she is not travelling, then she may apply for ILR under Long residence shorty before her leave expires. Else, apply for FLR(M).

ILR Clock Reset Query

Post by lomo » Tue Mar 07, 2023 10:47 pm

My wife arrived in UK in March 2013. I obtained ILR through long residence in 2021. My wife moved from Tier 2 dependant to FLR(M) in 2022. She is now hoping to apply for ILR based on ten year long residence as she completes 10 years in March 2023. I have read somewhere that the ILR clock resets when you move to FLR(M). Does that mean she is not eligible for ILR through 10 year long residence? does she have to wait 5 years from 2022, as she received FLR(M)in 2022.

It resets in the sense she would have to get 5 years on spouse visa if she would wish to get ILR that way.

All visas count for 10 year ILR. You're fine.

I merged your older previous post on the same question above. You were advised last year that she can get ILR under long residence :!:

ILR Long Residence Super Priority Service

Post by lomo » Mon Jul 31, 2023 1:58 am

Hi,

When we try to submit my wife's ILR (LR) application I only get the standard application option, I do not get any priority or super priority options. What's the reason for this? Is priority service offered now for ILR LR?

It is what is available at your time of checking that you get.
There is a thread or post about this from mod.
